Item 6b <br />AP-98-19 (UP-98-76/Z-98-311 and Z-98-310, Jack Chestnut} <br />Appeal of the Planning Commission's denial of applications for: (1) conditional use <br />permit and administrative design review approvals to construct a new, one-story, <br />apOroximately 600 sq.ft. detached secondary unit to be located adjacent to the eastern <br />side yard, in the approximate location of an existing detached accessory_ structure (the <br />existing accessory_ structure would be demolished), and (2) administrative design review <br />approval to construct an approximately 2,436 sq.ft. one and two story_ addition to the <br />existing 1,316 s~l.ft. dwelling located at 4128 Stanley Boulevard. Zoning for the property <br />is R-l-20,000 District. <br /> <br /> Mayor Tarver declared the public hearing open and continued the matter to the meeting <br />of February 16, 1999. <br /> <br />Item 6c <br />UP-98-19, Greenbriar Sycamore Valley Company <br />Application for a master conditional use permit to allow a detached second unit option as a <br />part of this development. Zoning for the property is PUD - LDR/A (Planned Unit <br />Development- Low Density Residential/Agriculture)District. (SR99: <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mr. Pico asked if the Planning Commission was in the process of reviewing the <br />ordinances regarding secondary units. <br /> <br /> Mr. Swift said the Planning Commission initiated a review of second units. Its <br />recommendation is that detached secondary units only be allowed in areas zoned R-l-10,000 or <br />larger. This area is zoned PUD-LDR, it does have the R-l-10,000 minimum lot size designation <br />and meets the Planning Commission's recommendations. Staff is recommending a ten foot rear <br />setback and a side yard setback of five feet. <br /> <br /> Ms. Michelotti asked how these recommendations compare to state law? <br /> <br /> Mr. Swift said state law regulates secondary units in the absence of a local ordinance. <br />Cities are allowed to adopt their own ordinance regarding secondary units and once adopted that <br />is the rule that applies. <br /> <br /> Mr. Pico asked when the proposed changes to the secondary unit ordinance would be <br />before Council. <br /> <br />Pleasanton City Council 7 02/02/99 <br />Minutes <br /> <br /> <br />
