Nelsons' issue warranted another look, it would be within the Council's discretion to look at the <br />matter at that time. <br /> <br /> Mr. Pico felt the tolling agreement had nothing to do with the West Foothill Overlay <br />District. He said if the Nelsons file a lawsuit, then the City would have the opportunity of <br />settling the lawsuit by agreeing to let the color stand or pursuing the lawsuit. <br /> <br /> Mr. Roush said if the guidelines are revised and Council decided to let the color stand <br />and the tolling agreement had been entered into, then there would be no reason for the Nelsons <br />to f'~e a lawsuit. If Council felt the color did not meet the guidelines as revised, then the tolling <br />agreement would be lifted. <br /> <br /> Ms. Dennis said it was her intention to review the guidelines to make sure they are <br />consistent with what is happening out there. She thought the Nelsons would request further <br />consideration once the guidelines are revised. <br /> <br /> Mr. Roush said if the Council wished to look at this funher, there is a way to bring the <br />item back. <br /> <br /> Ms. Michelotti said the only way the color could be reconsidered is if a pallet similar to <br />the Nelson's color was incorporated as part of the Foothill Overlay guidelines. <br /> <br /> Mr. Roush said if there is interest in discussing the tolling agreement, the issue could be <br />discussed in a closed session. <br /> <br /> Mr. Pico did not feel it needed to be discussed in a closed session. <br /> <br /> Mr. Roush said a tolling agreement is usually discussed in a closed session. The <br />agreement could, however, be discussed in a public session. He needed direction from Council <br />as to which way it wanted to pursue this issue. <br /> <br /> Mayor Tarver directed staff to schedule a closed session to discuss the issue before the <br />next meeting. <br /> <br /> Carole Varela, 3858 Mohr Avenue, had concerns about the rate of development <br />approvals throughout the City. She mentioned a referendum drive is presently going on which <br />will end February 4, 1999, 5:00 p.m. She thanked all the residents who are willing to join <br />together in supporting this process and gave her phone number, 462-1187.
