Adopt Resolution No. 99-008, appointing Kay Ayala as the alternate <br /> representative to the Economic Vitality Committee. (SR99:32) <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers- Dennis, Michelotti, Pico, and Mayor Tarver. <br />NOES: None <br />ABSENT: Councilmember Ayala. <br />ABSTAIN: None <br /> <br />5. MEETING OPEN TO THE PUBLIC <br /> <br /> Ms. Acosta introduced Billie Dancy as the new Director of Library Services. Ms. Acosta <br />gave a brief background of Ms. Dancy's qualifications and explained the transition of the library <br />from Alameda County to the City. <br /> <br /> Ms. Dancy said it was truly an honor to be here. She is very impressed with the positive <br />energy she has found in the staff working for the City of Pleasanton and is very excited about the <br />transition. <br /> <br /> Neil Nelson, 8088 Bethel Lane, referred to letters that had been submitted to Council on <br />February 1, 1999. He requested Council to toll the running of the statue for AP-98-15 until the <br />completion of the review for the West Foothill Road Corridor Overlay District. <br /> <br /> Mr. Roush said in the absence of a tolling agreement the time period for the Nelsons to <br />file a court action would be 90 days from January 5, 1999. Council does have the option of <br />waiting until the West Foothill Road Corridor Overlay District review comes forward. Once the <br />guidelines are revised the Council could consider another request from the Nelsons. If the <br />Nelsons were not to file a timely lawsuit, they would be foreclosed in the absence of a tolling <br />agreement. <br /> <br /> Mr. Pico felt the period for reconsideration had passed and that Council could only <br />consider extending the time that the Nelsons have to file a lawsuit. The revision of the West <br />Foothill Overlay District has nothing to do with the decision that has been made by the Council. <br /> <br /> Mr. Roush said that is correct. He said the Council has been flexible in looking at <br />matters when circumstances change.
