Mr. Swirl explained the level of service calculation done for the Muirwood/West Las <br />Positas intersection, which is currently a four-way intersection, was analyzed as a four-way stop <br />sign and not as a traffic light intersection. If it is analyzed as a four-way stop sign then the <br />delay is equivalent to a level of service F. The General Plan anticipates that the West Las <br />Positas intersection will be signalized and if the signal is installed it will operate at a level of <br />service B or C. <br /> <br /> Mayor Tarver understood that the only option to stay within the General Plan's limits is <br />to install the West Las Positas interchange and signalize Muirwood at West Las Positas if the <br />City keeps on growing the way it is growing. <br /> <br /> Mr. Swirl said that is correct but the current model does not include the kinds of <br />mitigations being looked at by the West Las Positas study committee. Those mitigations <br />potentially could also make the levels of service comply with the General Plan. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Mr. Pico asked for a copy of the minutes from the first public hearing. <br /> <br /> Jim Summers, The DeSilva Group, thanked staff for its hard work over the past two <br />years. He agrees with staff's conclusions and conditions within the staff report with the <br />following comments: (1) Allow one year to phase out the existing business; and (2) the four <br />proposed "school" conditions, he will agree to condition number three. Additionally he would <br />agree to abide by the existing residential flat fee agreement for this project. This agreement <br />provides for the payment of $4.83 per square foot and that fee may be adjusted annually by <br />inflation. By entering into this agreement, the DeSilva Group is fulfilling its obligation with <br />respect to the school impacts. He asked for Council's favorable action on this item. <br /> <br /> Mayor Tarver understood that he was not disagreeing with the school mitigation fee even <br />though Mr. Summer believes the DeSilva Group does not have to, based on Proposition 1A. <br /> <br /> Mr. Summers said The DeSilva Group has agreed to the $4.83 per square foot mitigation <br />fee and Condition No. 3 in the supplemental staff report. <br /> <br /> Robin Neal, 3843 Northwood Court, said the school issue brought up at the November <br />3 meeting was brought up by the neighbors. The School District projected dates are subject to <br />change. The main concern is density. If density is lowered, it will alleviate some of the other <br />problems. <br /> <br /> Bob Cordtz, 248 West Angela Street, asked if the Pleasanton Unified School District has <br />an agreement, contract or option to purchase the San Francisco land for an additional school site. <br /> <br /> Ms. Ayala said negotiations are going on now. <br /> <br />Pleasanton City Council 7 12/01/98 <br />Minutes <br /> <br /> <br />
