PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6d <br />AP-98-15, Neil and Pat Nelson <br />Appeal of the Planning Commission's determination that the applied house color and design <br />of a portion of the installed drainage system is not consistent with the design review <br />approval for the house currently under construction located at 8088 Bethel Lane. Zoning <br />for the property is R-I/40,000 single-family residential. (SR98:332) <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> It was moved by Ms. Ayala, and seconded by Ms. Dennis, to continue Item 6d to the <br />January 5, 1999 Council meeting. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarvet. <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6a <br />PUD-96-14, James and Hilda Merritt and DeSilva/Gates <br />Application for Planned Unit Development prezoning and development plan approval for <br />91 single-family homes (including three existing homes) on 46.4 acres located at 4131 and <br />4141 Foothill Road. Alameda County's zoning for the property is Agricultural District. <br /> <br />Also consider the Negative Declaration prepared for the project. (SR98:341) <br /> <br /> Brian Swirl presented the supplemental staff report. <br /> <br /> Mayor Tarver said page 28 of the Traffic Report, at Table 5, states that the northbound <br />ramps of Bernal Avenue under the "no West Las Positas interchange" scenario will be operating <br />at level of service E during both peak hours. There is also a footnote that states with the West <br />Las Positas interchange scenario the level of service would be acceptable. The project proposed <br />access column states that the 1-680/West Las Positas interchange option has a level of service <br />F at Muirwood/West Las Positas. He concludes that even though the intersections at Bernal <br />would operate within the level of service limits of the General Plan, the West Las <br />Positas/Muirwood intersection level of service would not comply with the General Plan. He <br />understood that no matter what is done, the City will still have a problem.
