She did not want <br />to disrupt the business and the classes though. <br /> <br /> Ms. Michelotti felt the business might become so popular it would outgrow its present <br />location. <br /> <br /> Mr. Pico appreciated the comments and the input on Mr. Oliveira's character. But he <br />could attest to Ms. Adams and Mr. Higgins character. He said they have fought to protect their <br />neighbor for a number of years. He was disappointed that Ms. Adams and Mr. Higgins did not <br />get a positive reaction when they approached Mr. Oliveira. He hoped to find a way to make <br />things work for everybody. He listed some of the problems this neighborhood has already faced <br />and will face in the future. He felt if Mr. Oliveira wanted to operate his business in this <br />neighborhood he needed to find a way to help mitigate the noise and to work with the <br />neighborhood to resolve the issues. Ray Street is a busy street and does have preexisting <br />conditions. He felt the concerns were justified. He was willing to approve a trial period in <br />order to make this work, but everyone will have to work together on this. <br /> <br /> Ms. Michelotti asked if the process would be to grant the permit and then review it in <br />six months or is the permit being deferred for six months. <br /> <br /> Mayor Tarver said Council would give staff direction on how to proceed. Council will <br />either approve the conditional use permit or deny the application. What conditions are to be <br />imposed is up to the Council's discretion. <br /> <br /> Ms. Acosta said that if Council is inclined to allow the business to continue operating, <br />it is better to issue a conditional use permit for a period of six months. <br /> <br /> Mayor Tarver appreciated the community's support for Mr. Oliveira's character but the <br />real issue is if the business is compatible in its present location. He agreed that maybe this is <br />not the right location, even if there was a martial arts school in this location before. His belief <br />is that the business is not compatible with the neighborhood and the best course of action is <br />finding a better location. He supports the conditional use permit because of the conditions and <br />if a business cannot operate under specified conditions then Council has to consider revoking the <br />conditional use permit. He felt this would happen on this project. He did not want to see the <br />business fail or create a financial burden, but felt Mr. Oliveira needed to find a better location <br />that would not create potential problems down the road. He trusted that the noise, signage and <br />parking issues could be resolved, but not the constant traffic created by the business. He was <br />willing to approve the conditional use permit with the conditions listed.
