Mr. Rasmussen said yes. <br /> <br /> Ms. Michelotti said a restaurant would have more traffic than Mr. Oliveira's business. <br />She felt filling a space with a less intensive use was better than a more intensive use. She <br />commented that Mr. Oliveira has put forth a good faith effort and if he continued, the business <br />would outgrow the site and in the long term he would have to relocate anyway. She did not <br />know of any other use that could go in there that would not have the same issues. She was <br />willing to support the appeal. <br /> <br /> Ms. Dennis had a concern that the business would not work out the issues in six months <br />and preferred the six months was to allow time for the business to move. She wanted to add <br />a condition stipulating the students should approach the shopping center from Main and Ray to <br />allow for a right hand turn into the parking lot. <br /> <br /> Ms. Acosta said it would be hard to enforce such a condition. <br /> <br /> Ms. Michelotti asked if a pattern could be established having the vehicles enter the first <br />entry and exit the second entry making a right hand turn onto First Street. This would create <br />an orderly pattern and ease the congestion on Ray Street. <br /> <br /> Ms. Ayala asked the length of the lease. <br /> <br /> Mr. Oliveira said there are four years left on the lease. <br /> <br /> Ms. Michelotti asked how long the conditional use permit would be in effect. <br /> <br /> Mr. Rasmussen said indefinitely or whatever length of time the Council chooses. <br /> <br /> Ms. Ayala said five years was too long and asked if Mr. Oliveira would be able to <br />renegotiate his lease. <br /> <br /> Mayor Tarver asked if the lease was valid if the conditional use permit is not approved. <br /> <br /> Mr. Roush suggested Council focus on the conditions it wanted to apply and allow the <br />lease issue to work itself out. <br /> <br /> Ms. Michelotti suggested a motion to approve the CUP for a four year term with a <br />review in six months. <br /> <br /> Ms. Dennis made a motion to make the conditional use permit a rolling permit for one <br />year with a review in six months to allow for the issues to be worked out; if not, the remaining <br />six months would allow time for the business to relocate. <br /> <br />Pleasanton City Council 14 10/20/98 <br />Minutes <br /> <br /> <br />
