Jack Hovingh, 4250 Muirwood Drive, objected to the sale of gasoline and
alcohol at the same place. He received an e-mail from someone in Washington
that commented the sale of alcohol and gasoline at the same place in that state
was illegal. He thought it should be that way for Pleasanton. He said the
Council should be consistent. The Council passed a firearm ordinance prohibiting
the sale of firearms in certain places. He felt this issue was just as important.

Ms. Michelotti said Mr. Hovingh's comments were appropriate. She
believed there had been a precedent set on this. She said there are not a lot of
businesses that sell both alcohol and gasoline. She made her decision based on
economics and that the project would fit in the area.

Ms. Dennis said under normal circumstances she would not have voted
yes. However, it would be the only service station owner in the City of
Pleasanton not permiUed to have this arrangement and she felt that was not fair.
She also believed that this business would have a minimal negative impact on the
community for the sale of alcohol. It is not against the law to sell alcohol, but
if it were she would enforce the law.

Mayor Tarver said he looks at the principle of the issue and the principle
is that alcohol and gasoline do not mix and should not be sold together.

m.
