Mr. Lum said yes. <br /> <br /> Mayor Tarver understood that the 80% left after the 20% is set aside for particular <br />projects will be given to the JPA treasurer to hold in an interest bearing account and it would <br />continue to accumulate until the agencies decided upon a project. <br /> <br /> Mr. Lum said that is correct. <br /> <br /> Mayor Tarver asked what would happen if the agencies could not agree on the next <br />project. <br /> <br /> Mr. Lum said the JPA states that a strategic expenditure plan will be approved <br />unanimously within six months of the effective fee date; if that does not occur, then an agency <br />may press the issue if it chooses to stop collecting the fee. Then the JPA would have to be <br />looked at to determine if it is valid. <br /> <br /> Mr. Roush said funds will be collected during the six months for the initial project. If <br />the six month deadline is not met, then a decision would have to be made as to whether the JPA <br />should be amended or dissolved. A problem would occur only if the strategic expenditure plan <br />could not be agreed upon, after the 1-580/1-680 project is fully funded and reimbursements have <br />been made. <br /> <br /> Ms. Michelotti said the six months was chosen to give time for the expenditure plan to <br />develop. It is understood that the 1-580/1-680 interchange would go forward and all the fees <br />would be going toward that project. The time for paying this project off is one to two years. <br /> <br /> Ms. Acosta said if an agreement is not reached within six months the jurisdictions could <br />choose to extend the time. <br /> <br /> Ms. Michelotti said there have been eleven projects agreed upon. The first phase is the <br />1-580/I-680 interchange. Livermore requested a thirty day opt out clause, in case an agreement <br />cannot be reached on the expenditure plan. <br /> <br /> Ms. Ayala asked if six months was a realistic. She hoped to reach an agreement much <br />sooner. She encouraged Ms. Michelotti as chairperson to reach an agreement. <br /> <br /> Ms. Michelotti said most of the jurisdictions already have its priorities. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Kris Kumaran, 6450 Calle Esperanza, said with the growth of Pleasanton, by the year <br />2020 the traffic impacts will be significant and any efforts that Pleasanton and neighboring <br />jurisdictions can take to mitigate or at least plan for this is vital and essential.
