Mr. Lum said that is correct. <br /> <br /> Mayor Tarver asked staff to explain the 20 % set aside and how it works. <br /> <br /> Mr. Lum said Contra Costa's legal counsel advised the County that it could not use the <br />collected fee revenues for transit projects based on the way the fee was being collected. <br />Therefore, this excluded the west Dublin BART station and the bus project. Contra Costa also <br />has a southern Contra Costa Joint Powers Agreement that also imposes a regional transportation <br />fee, which requires the County to dedicate a portion of the fee being collected toward the <br />Alcosta interchange and auxiliary lane. Contra Costa maintains that of the money being <br />collected by the Tri-Valley Transportation Council on its behalf, 20% has to be used for a <br />project under the other JPA. Therefore the other agencies are asking for the same consideration. <br />The JPA reflects that each agency may use the 20 % set aside for a particular designation on any <br />one of the eleven projects. <br /> <br /> Ms. Michelotti said Contra Costa not participating in the west BART station was a legal <br />issue, but the jurisdictions north of 1-580 will receive benefits from the BART station. The <br />money collected from Contra Costa is still going to TVTC, but will be directed to another <br />project rather than to the BART station. <br /> <br /> Mayor Tarver understood that all the other agencies wanted 20% set aside if Contra <br />Costa was getting 20%. <br /> <br /> Ms. Michelotti said the other jurisdictions felt everyone should have a choice to designate <br />what project it wanted its 20% set aside for. <br /> <br /> Mayor Tarver asked, if an agency does not take action within 30 days of the draft <br />expenditure program, the agency is in the program and there is no way to get out until all of the <br />projects are completed. It requires unanimity of all the agencies to develop the expenditure plan <br />or to modify the plan. The JPA also requires unanimity of all the agencies to determine how <br />the reimbursements will be made. <br /> <br /> Mr. Lum said that is correct. <br /> <br /> Mayor Tarver said the JPA talks about the following criteria: project readiness, safety, <br />and leveraging state and federal funds. Are these the only criteria to be used and does one have <br />priority over the other? <br /> <br /> Mr. Lum said the criteria established by Tri-Valley Transportation Council was for <br />consideration of priority.
