Mr. Roush said there are certain limitations on the restrictions regarding first amendment <br />rights. The question is whether the person soliciting is doing so as first amendment protected <br />activity or if it is in fact a profit making activity. He said the City is in the process of reviewing <br />both the general and charitable solicitation ordinance. In the interim he will respond to the Mr. <br />Tolvtvar's request regarding the current ordinance. <br /> <br /> Mayor Tarver said when the ordinance comes before Council, there will be an <br />opportunity for public input. <br /> <br />6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />Weed Abatement Program 1998 (SR98:99) <br /> <br /> Fire Chief Gary presented the staff report. <br /> <br /> Ms. Ayala asked if the list was shorter than last year. <br /> <br /> Chief Gary said no. <br /> <br /> Mr. Pico said last year there were issues regarding the properties along the Arroyo del <br />Valle. He wanted to know if these had been addressed. <br /> <br /> Chief Gary said his department is working closely with the property owners to help them <br />understand their obligations. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> There being no speakers the public hearing was closed. <br /> <br /> It was moved by Ms. Michelotti, and seconded by Ms. Ayala, to adopt Resolution <br />No. 98-37, approving the 1998 Weed Abatement Program and authorizing staff to proceed <br />with abatement of weeds, rubbish or refuse upon or in front of certain described properties <br />within the City of Pleasanton which constitute a public nuisance. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Michelotti, Pico and Mayor Tarver. <br />NOES: None <br />ABSENT: Councilmember Dennis. <br />ABSTAIN: None <br /> <br />Pleasanton City Council 5 4/21/98 <br />Minutes <br /> <br /> <br />
