Ms. Michelotti said people are very concerned with the groundwater basin and felt that <br />education forums should be held. She said the residents need to be satisfied that this is in their <br />best interest. She felt an advisory vote of the public reaffirms that it truly is not detrimental or <br />adversely affects the current residents. <br /> <br /> Mr. Marchand said during the negotiations it became evident that there was, in fact, a <br />benefit to the residents of Zone 7. <br /> <br /> Ms. Michelotti would like to see Zone 7 in control of the fourth share rather than another <br />user. <br /> <br /> Mayor Tarver asked Mr. Marchand his opinion of the initiative process and who he <br />thought should be able to vote on it. <br /> <br /> Mr. Marchand stated he was not a lawyer. Today is the first he had heard anything in <br />respect to what jurisdiction Zone 7 will look at. He felt that it would be only for the Zone 7 <br />residents. <br /> <br /> Mr. Pico asked if he would raise the issue regarding Zone 7 taking the Dougherty Valley <br />expansion to the vote of the people at the next Board meeting. <br /> <br /> Mr. Marchand said he would. He said the next board meeting is April 22, 1998. <br /> <br /> Mayor Tarver asked how he could agree to the principles of understanding at that Board <br />before the lapsing of the policy. <br /> <br /> Mr. Marchand said the language is not significantly different from the language of which <br />the Zone 7 Board had committed to. The specific language has not been agreed upon just the <br />intent. <br /> <br /> Jim Day, 745 Carland Drive, Livermore, said Zone 7 was formed under the Alameda <br />County Water Act. The Act states no water shall be imported out of the district. He felt this <br />was very clear. Therefore he wondered why all the discussions, comments, etc. were going on <br />because it would be illegal for Zone 7 to expand its services outside its own district. He felt <br />advisory votes were not binding except for political welfare of the people. He commented that <br />four members of the Zone 7 Board said they would not vote to expand service outside its own <br />district. He invited the City of Pleasanton to join in CDBG's law suit against the legality of <br />Zone 7's action. <br /> <br /> Mr. Marchand said the District Act states that the District has the power to take "any <br />action or proceeding involving or affecting ownership or use of waters or water rights within <br />or without the District, used or useful for any purpose of the District or of common benefit to <br />the lands within the District or to its inhabitants."
