Ms. Ayala appreciated what has been going on and hoped Zone 7 will be responsive. <br />She also hoped the citizens will begin going to the Zone 7 meetings. <br /> <br /> Mr. Marchand said he has been talking to the citizens through this whole process. Two <br />years ago a staff member indicated that the City of Livermore supported Zone 7 supplying water <br />to Dougherty Valley. He did not hear from the City of Livermore until the night of Zone 7's <br />vote on Dougherty Valley, where the City opposed it. So the question in the newspaper asking <br />where were you two years ago, was directed at the City of Livermore. <br /> <br /> Ms. Dennis was convinced that Zone 7 felt Dougherty Valley was good for the system <br />and would not have an adverse impact on current residents. She hoped Zone 7 would consider <br />putting this before the people for a vote. <br /> <br /> Mr. Marchand said when this issue was considered two years ago, the Board voted not <br />to go to a vote of the people. Throughout the process though, guidelines have been put in that <br />an election will be held for a significant expansion. <br /> <br /> Mayor Tarver said the fundamental difference is if the City can agree or make a <br />compromise to say the agreement is good enough. He said the version of the agreement by <br />Zone 7 states, "unless the Board. in its deliberations makes a finding of exception that such <br />service extension would not adversely impact existing customers." He understood that Zone 7 <br />believed its deliberations made that finding as it relates to the Dougherty Valley and that four <br />of the Board members chose not to put this before a vote of the people. Therefore he had <br />concerns with the word "unless" used in the language. He wanted Zone 7 to explain again the <br />Board's position as to why it felt the word "unless it makes a finding" in its deliberations. <br /> <br /> Mr. Marchand said putting this issue to the vote of the people had never been considered <br />by the Board. The power of the Board was granted by the electorate. <br /> <br /> Mayor Tarver understood there were not four votes to put this on the ballot. <br /> <br /> Mr. Marchand said this has never been considered by Zone 7, but now Zone 7 is behind <br />having an election. <br /> <br /> Ms. Michelotti said the negotiations were for future expansions. She thanked Mr. <br />Marchand for coming here this evening. She was glad that Zone 7 had agreed that with future <br />expansions it would go to a vote. She felt this was a step in the right direction. She talked <br />about the Arroyo and that she wanted to make those that cause the problem responsible for the <br />solution. <br /> <br /> Mr. Marchand said a task force has been set up to look at the impacts and to come up <br />with possible solutions. <br /> <br />Pleasanton City Council 7 03/31/98 <br />Minutes <br /> <br /> <br />
