Ms. Ayala asked Councilmember Pico to address what else he would like changed.

Mr. Pico said he had problems with the definitions. He felt the Glock gun should be on
the list. He suggested putting the Glock gun on the list and see how the appeals process worked.

Ms. Dennis said there was a gun that was not on the list because it was currenfiy under
appeal.

Mr. Pico wanted to modify the definition to address the real concern about safety, poo~y
manufactured weapons, and deficient parts. He could not support the ordinance the way it was
written.

Ms. Ayaia asked if he felt the ordinance did not have a definition that the City could
follow?

Mr. Pico said the definition did not meet the purpose as to why this ordinance was being
created and that there were probably others guns that met the definition that were not on the
roster. He wanted the definition to be more specific.

Ms. Ayala asked staff if the ordinance was banning nineteen manufacturers who have
poo~y made small handguns.

Mr. Roush said the ordinance is banning the sale of cheaply made, inadequately designed,
poorly manufactured hand guns. The ordinance states the definition and according to the
definitions, certain guns were determined to be poorly made. This list is what is before Council
tonight to be adopted.

Mayor Tarver said only one manufacturer has appealed.

Mr. Pico said he has heard testimony tonight that what actually should be looked at is
the stressed parts of the guns. He felt this is what should be addressed.

Ms. Ayala believed if the manufacturers felt their guns were safe they would appeal.

Ms. Dennis felt the ordinance did what Councilmember Pico was requesting. She did
not want to amend the ordinance without further research. She was not opposed to amending
the ordinance. She did not feel changing five words in the ordinance would eliminate people's
concerns. She was certainly willing to look at modifying it though.

Ms. Michelotti was concerned with the inconsistency in the definition and the firearms
not on the list. She was looking for a way that certain firearms would be exempt from the
ordinance.

Pleasanton City Council 3/03/98
Minutes 29
