Mayor Tarver was concerned about relaxing the standards. He said there is an established Specific Plan that the people wanted Council to follow. Mr. Swift said there is the ability for the Planning Commission to review it on a case by case basis in conjunction with Greenbriar's tentative map. Ms. Michelotti felt it was the fair thing to do. It was moved by Ms. Ayala, seconded by Ms. Michelotti, to amend the condition regarding setbacks on all properties between Greenbriar and Sunol Boulevard, to provide that the setbacks go to the Planning Commission at the time of the tentative map for this project. The roll call vote was as follows: AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver. NOES: None ABSENT: None ABSTAIN: None Mayor Tarver asked if the secondary units would go back to the Planning Commission for specific conditions. It was moved by Ms. Dennis, seconded by Ms. Michelotti, that Condition "X" be adopted as follows: The developer shall offer detached second units for certain lots within the project except those abutting properties to the north. The detached second units shall be allowed under the same conditions of approval as attached units. The setbacks, height, floor area ratio, and architecture design for detached second units shall be established by the Planning Commission in conjunction with its review of the tentative map, said regulations to be generally those of the R-I-IO,O00 zoning district and then come before the Council for final approval. Mr. Swift said if Council was looking for a recommendation from the Planning Commission then the condition needed to be modified. He suggested adding a new condition stating detached second units be referred to the Planning Commission for its recommendation. Mr. Pico said he would be happy to do that except for those properties along the north side. Ms. Michelotti asked if the secondary units needed to go to the Planning Commission. Ms. Dennis said yes.
