Mayor Tarver declared the public hearing open.

Will McThewson, 1137 N. McDowell, Petaluma, said the new Chevron station will
operate for 24 hours along with the existing Shell station and Safeway shopping center, therefore
the noise levels should not increase. The sale of alcoholic beverages will be limited to beer and
wine only and will not be a featured item. Chevron has agreed to staff recommendations and
conditions. He had a question regarding the exterior window for the office space. He said a
window to the exterior is a security issue and might create problems with energy compliance.
He requested that the issue be resolved at the staff level rather than be a stated condition.

Mayor Tarver asked staff if they understood that there was a misunderstanding about the
condition.

Mr. Swift said he was not sure.

Ms. Ayala asked if the dealer or planning staff requested the window.

Mr. Swift said it was at the request of staff. There is a window adjacent to the office
where the cashier is and staff felt it was an appropriate place to put a window.

Ms. Michelotti asked if the window on the inside could give enough light to the room.

· Mr. Swift said staff was happy to work this out with the applicant.

Mr. McThewson said the office would be used more for storing high security items that
people like to steal and all the video and alarm equipment. Because of.this he did not see the
need for a window for lighting, if a window was there it would be looking at a trash dumpster
approximately five feet away. Also he did not see the need to have individual trash bins at each
pump island as there is a large trash dumpster nearby.

Mayor Tarver asked if there were trash receptacles by the food mart or by the air and
water service.

Mr. McThewson said there will be one in the food and water area and the patrons of the
food mart can go inside or outside to dump their trash. He also felt that a third party peer
review for the grading to be submitted to the Director of Building Inspection was unnecessary.
He said the building on the site has existed for a number of years and felt this was an
unwarranted additional expense.

Mr. Swift said revisions to the General Plan require that studies be subject to third party
peer review and that is why this condition appears.

Pleasanton City Council 30 08/18/98
Minutes
