F. The City Council has been petitioned by the home owners <br />of the mobile home parks to establish a rent stabilization <br />ordinance. <br /> <br /> G. At the public hearing on the establishment of such an <br />ordinance, representatives of the Park Owners had suggested that <br />alternatives to the establishment of a rent review ordinance be <br />considered. <br /> <br /> H. This agreement is intended to reflect an arrangement for <br />resolving issues within the mobile home parks without the <br />necessity of the City adopting a rent review ordinance. <br /> <br /> NOW, THEREFORE, in consideration of the faithful performance <br />of the terms, conditions, covenants, and promises set forth <br />herein, the parties agree as follows: <br /> <br />I. DEFINITIONS <br /> <br /> Ao "Base Rent" - The space rent for each mobile home space <br />in Pleasanton as it existed on November 1, 1987 and as more <br />precisely delineated in Exhibit "A" to this agreement. <br /> <br /> B. "Capital Improvements" - Capital improvements are any <br />additions or betterments made to a park such as, but not limited <br />to, a new swimming pool, a new building, a new fence or a new <br />road where one of the same size, function and quality had not <br />existed before. For the purpose of this agreement, the <br />substantial rehabilitation or replacement of any existing capital <br />improvements in any park such as rebuilding the driveway or <br />replacement of the sewer line shall be treated as a capital <br />improvement. <br /> <br /> C. "Cost of Living" ("COL") - The change in the Consumer <br />Price Index for the San Francisco-Oakland-San Jose Metropolitan. <br />Area (All Items Index; All Urban Consumers) for the twelve (12) <br />month period ending in August each year as published by the <br />Bureau of Labor Statistics, U. S. Department of Labor. If this <br />index shall delete the rental housing index, then a rental <br />housing index shall be selected by the Pleasanton Mobile Home <br />Committee for inclusion in computing the appropriate cost of <br />living adjustments. Exhibit "B" shows the Consumer Price Index <br />for 1987. <br /> <br /> D. "Home Owner" - Any person entitled to occupy a mobile <br />home dwelling unit pursuant to ownership thereof or a rental or <br />lease arrangement with the owner thereof. <br /> <br /> E. "Pleasanton Mobile Home Committee" or "PMHC" - A <br />committee established by this Agreement in the City of Pleasanton <br />to improve communications, identify problems and attempt to <br />resolve any problems which may exist within each mobile home <br />park. <br /> <br /> F. "Members" - Those individuals who serve on the <br />Pleasanton Mobile Home Committee, and any alternates. <br /> <br /> - 2 - <br /> <br /> <br />
