G. "Mobile Home Park" or "Park" - any area or land within <br />the City of Pleasanton where two or more mobile home spaces are <br />rented, or held out for rent, to accommodate mobile homes used <br />for human habitation. <br /> <br /> H. "Operating Expenses" - The direct costs of operating a <br />mobile home park as delineated more precisely in paragraph VIII. <br /> <br /> I. "Park Owner" - The owner, lessor, operator, or property <br />manager of a mobile home park within the City of Pleasanton. <br /> <br /> J. "Petition" - A form approved by the Members which must <br />be signed and returned to the PMHC before the PMHC will invoke <br />its jurisdiction pursuant to this Agreement. <br /> <br /> K. "Petitioner" - The person(s) who submits a petition to <br />the Chair of the PMHC as required by this Agreement. <br /> <br /> L. "Prime Rate" - The prime rate as shown in the Wall <br />Street Journal for July 1 of each calendar year or the next <br />business day thereafter. <br /> <br /> M. "Respondent" - The person who has not filed a petition <br />but who is necessary to the resolution of the subject matter of <br />the petition. <br /> <br /> N. "Space Rent" - The consideration, including any bonus, <br />benefits, or gratuity, demanded or received in connection with <br />the use and occupancy of a mobile home park or for the transfer <br />of a lease for park space, services and amenities, subletting and <br />security deposits, but exclusive of any amounts paid for the use <br />of the mobile home dwelling unit. <br /> <br />II. SUSPENSION OF RENT STABILIZATION REQUEST <br /> <br /> In consideration of the execution of this Agreement by the <br />Park Owners, City shall suspend consideration of the adoption of <br />the mobile home rent stabilization ordinance which is presently <br />before the City Council. If, however, any Park Owner shall fail <br />to fulfill its obligations under this Agreement, or if any new <br />Park Owner shall fail to agree to abide by terms and conditions <br />substantially similar to those set forth in this Agreement, then <br />the City will again consider enactment of a mobile home space <br />rent stabilization ordinance. If it becomes necessary for the <br />City to adopt a mobile home rent stabilization ordinance, those <br />Park Owners who are signatory to this Agreement and who are <br />operating their parks in compliance with the terms of this <br />Agreement shall be exempted from the mobile home rent <br />stabilization ordinance for the remaining term of this Agreement. <br /> <br />III. FORMATION OF THE PLEASANTON MOBILE HOME COMMITTEE <br /> <br /> A. Five Members.
