The industrial areas of Pleasanton that are included on the <br />CHWMP maps include the Commerce Circle/Johnson Drive area, <br />Rheem Drive Industrial Park, Valley Business Park and <br />Boulder Street, the area between Busch Road and Stanley <br />Blvd, and the Kaiser facility area west of Sunol Blvd. <br />Since the final CHWMP will ultimately become part of the <br />City's General Plan, the City must be prepared to accept its <br />responsibility to host facilities in these areas. <br /> <br />It should be understood, however, that the City is still <br />allowed its regular development review and permitting <br />procedures, along with the CEQA process when reviewing <br />potential facilities. The City already permits hazardous <br />waste facilities, including residual repositories, in its I-G <br />(General Industrial) Zoning District with a conditional use <br />permit. <br /> <br />The plan proposes that in the case of multi-user hazardous <br />waste facilities, the County Waste Management Authority and <br />an Authority-appointed Local Assessment Committee will play a <br />key role in the review of any facilities. They would be <br />involved in analyzing compliance with the goals, policies and <br />siting criteria of the CHWMP and in negotiating development <br />standards with the developer. The exact processing <br />procedures for their involvement are still to be developed. <br />Staff suggests a procedure be incorporated in the CHWMP which <br />is the same as that satisfactorily used for solid waste <br />facilities: the City is the lead agency, but the Authority <br />is a "responsible "permitting agency as well. <br /> <br />If a development is ultimately denied by the local <br />jurisdiction, the Tanner Bill provides for a State level <br />Appeal Board to review appeal requests made by the developer <br />or other interested party. If the proposed project is found <br />by the State to be in conformance with the CHWMP, the Appeal <br />Board can ultimately overturn the local decision. <br /> <br />ANALYSIS <br /> <br />Out of meetings between the City's Chemical Specialist and <br />Planning staff, there are several key areas of discussion <br />which may warrant further consideration and comment regarding <br />the siting criteria and implementation strategy in the <br />CHWMP. <br /> <br />Access <br /> <br />There is some inconsistency in the wording of the <br />inclusionary siting criteria over "Good Access" and "Safe <br />Access". Good access means that a facility is located on <br />major paved roads designed to accommodate heavy vehicles, <br />with good access to public highway routes and which do not <br />require trucks carrying hazardous wastes to pass through <br />residential neighborhoods. <br />SR:88:299 <br /> <br /> <br />
