ARTICLE 2 <br /> MAINTENANCE OF STREET LIGHTING <br /> <br />2.1 Areas for Street Lighting Maintenance. The <br /> Association shall maintain (i) all street lighting <br /> within Owens Drive from the northern boundary of the <br /> crossing of Tassajara Creek (including the culvert <br /> crossing of Tassajara Creek) to West Las Positas <br /> Boulevard; and (ii) all median street lighting within <br /> Andrews Drive between Owens Drive and Old Santa Rita <br /> Road. <br /> <br />2.2 Maintenance Requirements. The Association shall at <br /> its sole expense maintain all street lighting within <br /> the area described in Section 2.1. Maintenance shall <br /> include the payment of all charges for electrical <br /> usage, and the care of all street lighting <br /> electroliers and bulbs, including repair and <br /> replacement where necessary; provided that the <br /> Association's obligations under this section with <br /> respect to the area described in Section 2.1 shall not <br /> include the replacement or repair of street lighting <br /> electroliers unless ownership of said electroliers is <br /> conveyed to the Association or the City. <br /> <br />2.3 Term of Maintenance Obligations. The Association's <br /> obligations under Section 2.2. shall commence upon <br /> the later of (i) the date of this agreement, or (ii) <br /> the date upon which the City Council of the City <br /> accepts ownership of the street improvements and other <br /> public improvements under construction and shall <br /> continue throughout the term of this agreement. <br /> <br /> ARTICLE 3 <br /> MAINTENANCE OF BUS SHELTERS AND STREET SIGNAGE <br /> <br />3.1 Bus Shelters. The Association shall at its sole <br /> expense clean, maintain, repair, and replace, where <br /> necessary, all bus shelters located in Public Service <br /> Easements along Owens Drive from Tassajara Creek to <br /> West Las Positas Boulevard and remove trash from trash <br /> receptacles at such bus shelters. Cleaning and trash <br /> removal shall be done as frequently as reasonably <br /> necessary to maintain the bus shelters in a sightly <br /> condition, provided that trash removal shall be done at <br /> least weekly. <br /> <br /> <br />
