3.2 Street Siqnage. The Association shall at is sole <br /> expense maintain, repair, and replace, where necessary, <br /> all street signs and traffic control signs located in <br /> the areas described in Section 1.1 and in the Public <br /> Service Easements along Owens Drive from Tassajara <br /> Creek to West Las Positas Boulevard. <br /> <br /> 3.3 Term of Obliqation. The Association's obligations <br /> under Sections 3.1 and 3.2 shall commence upon the <br /> date of this agreement. The Association's obligations <br /> shall terminate upon the earlier of (a) expiration of <br /> the term of this agreement, or (b) for any <br /> improvements described in Section 3.1 and 3.2 located <br /> on any parcel shown on Parcel Map No. 4390, upon <br /> commencement of construction of improvements for <br /> development of all or any portion of the parcel in <br /> which such improvement is located. <br /> <br /> ARTICLE 4 <br /> PERMISSION TO ENTER <br /> <br /> The City hereby grants to the Association' and its agents, <br />employees, and contractors permission to enter upon any real <br />property within the areas described in Sections 1.1, 2.1, 3.1 <br />and 3.2 owned by the City or for which the City has been granted <br />a public service easement or temporary landscape easement, for <br />the purposes of performing any maintenance required under <br />Sections 1.2, 2.2, and Article 3, provided that any and all <br />contractors employed by the Association to perform any <br />maintenance required under Sections 1.2, 2.2, and Article 3 must <br />obtain an encroachment permit from the City, which the City shall <br />issue without charge to such contractor or to the Association. <br /> <br /> ARTICLE 5 <br /> ASSESSMENT DISTRICT <br /> <br /> 5.1 Maintenance District Contemplated. The City, <br /> Prudential, CPPP and the Association contemplate the <br /> possible establishment of a landscaping and street <br /> lighting maintenance district (the "District") <br /> pursuant to California law for the purposes of <br /> maintaining the landscaping, street lighting, and <br /> other public improvements covered by this agreement. <br /> <br /> <br />
