ARTICLE 3 <br /> MAINTENANCE OF TRAFFIC SIGNALS AND BUS SHELTERS <br /> <br />3.1 Traffic Siqnals. The City shall maintain, or contract <br /> to have maintained all traffic signals within Hacienda <br /> Business Park, all traffic signals on Hopyard Road <br /> between Owens Drive and Valley Avenue, inclusive, and <br /> the traffic signal at the intersection of West Las <br /> Positas Boulevard and Santa Rita Road (collectively, <br /> the "Traffic Signals"). Maintenance shall mean the <br /> care of the Traffic Signals, including repair and <br /> replacement where necessary. If the City elects to <br /> contract for such maintenance, the City shall exercise <br /> due diligence to minimize the cost of the contract. <br /> The Association shall reimburse the City for the actual <br /> cost of maintenance of the Traffic Signals. The <br /> Association shall be directly billed for and shall pay <br /> all electricity charges resulting from the operation of <br /> the Traffic Signals. Reimbursement to the City for <br /> maintenance costs shall be made within thirty (30) days <br /> after receipt by the Association of a statement from <br /> the City for the Association's share of such charges <br /> accompanied by copies of invoices from the contractors <br /> performing such maintenance, which invoices from the <br /> contractors performing such maintenance, which <br /> invoices demonstrate that said contractors have been <br /> paid by the City. <br /> <br />3.2 Bus Shelters. The Association shall at its sole <br /> expense clean, maintain, repair, and replace, where <br /> necessary, all bus shelters designated on Exhibit H, <br /> attached hereto and made a part hereof and remove trash <br /> from trash receptacles at such bus shelters. Cleaning <br /> and trash removal shall be done as frequently as <br /> reasonably necessary to maintain the bus shelters in a <br /> sightly condition, provided that trash removal shall be <br /> done at least weekly. <br /> <br />3.3 Street Signage. The Association shall at its sole <br /> expense maintain, repair, and replace, where necessary, <br /> all street signs and traffic control signs located in <br /> the areas described in Sections 1.1.1, 1.1.2, and <br /> 1.1.3. <br /> <br />3.4 Structures. The Association shall at its sole expense <br /> maintain, repair, and replace, where necessary, the <br /> steel structures. walls, and bollards located in the <br /> areas described in Sections 1.1.1 and 1.1.2. <br /> <br /> 10 <br /> <br /> <br />
