ARTICLE 2 <br /> MAINTENANCE OF STREET LIGHTING <br /> <br />2.1 Areas for Street Lighting Maintenance. The <br /> Association shall maintain all street lighting within <br /> the following areas: <br /> <br /> 2.1.1 Hopyard Road. Hopyard Road from the Arroyo <br /> Mocho Canal to Owens Drive, inclusive of <br /> said intersections; <br /> <br /> 2.1.2 Hacienda Business Park. Hacienda Business <br /> Park as described in the Declaration; <br /> <br /> 2.1.3 West Las Positas Boulevard. The area <br /> described in Section 1.1.3 (including area <br /> lighting); and <br /> <br /> 2.1.4 Santa Rita Road. Central medians for Santa <br /> Rita Road between Pimlico Drive and Sutter <br /> Gate Avenue, inclusive of said intersections. <br /> <br />2.2 Maintenance Requirements. The Association shall at <br /> its sole expense maintain all street lighting within <br /> the areas described in Section 2.1. Maintenance shall <br /> include the payment of all charges for electrical <br /> usage, all cost of ownership charges, if any, and the <br /> care of all street lighting electroliers and bulbs, <br /> including repair and replacement where necessary; <br /> provided that the Association's obligations under this <br /> section with respect to the area described in Section <br /> 2.1.1 shall not include the replacement or repair of <br /> street lighting electroliers unless ownership of said <br /> electroliers is conveyed to the Association or the <br /> City. <br /> <br />2.3 Terms of Maintenance Obliqations. The Association's <br /> obligations under Section 2.2 shall commence upon the <br /> later of (i) the date of this agreement, or (ii) the <br /> date upon which the City Council of the City accepts <br /> ownership of the street improvements and other public <br /> improvements under construction and shall continue <br /> throughout the term of this agreement, unless <br /> terminated as provided in Section 6.3. <br /> <br /> <br />
