3.5 Term of Obligation. The Association's obligations <br /> under Sections 3.1 through 3.4, inclusive, shall <br /> commence upon the date of this agreement and shall <br /> continue throughout the term of this agreement, <br /> provided, however, that the Associations obligations <br /> under Section 3.2 with respect to any bus shelter <br /> designated as "Potentially Terminable" on Exhibit H <br /> shall terminate concurrently with termination under <br /> Section 1.4 of the Association's obligations to <br /> maintain landscaping under Section 1.2 for any parcel <br /> of real property upon which such bus shelter is <br /> located. <br /> <br /> ARTICLE 4 <br /> MAINTENANCE OF STREETS <br /> <br /> The Association shall pay to the City an amount equal to the <br />estimated cost, as determined by the City Engineer, of the <br />maintenance of all public streets within Hacienda Business Park <br />for a period of ten (10) years commencing upon the date of the <br />city's acceptance of the public streets within Hacienda Business <br />Park. The Association and the City agree that such estimated <br />maintenance cost is Five Hundred Four Thousand and no/100ths <br />Dollars ($504,000.00). The Association shall pay said amount in <br />ten (10) equal annual installments of Fifty Thousand, Four <br />Hundred and no/100ths Dollars ($50,400.00), each installment <br />being due and payable on December 30 of each year, commencing on <br />December 30, 1984 and continuing until December 30, 1993. <br /> <br /> ARTICLE 5 <br /> PERMISSION TO ENTER <br /> <br /> The City herewith grants to the Association and its agents, <br />employees, and contractors permission to enter upon any real <br />property within the areas described in Sections 1.1, 2.1, and 3.1 <br />through 3.4 owned by the City or for which the City has been <br />granted a public service easement or temporary landscape <br />easement, for the purposes of performing any maintenance required <br />under Sections 1.2, 2.2, and 3.1 through 3.4, provided that any <br />and all contractors employed by the Association to perform any <br />maintenance required under Sections 1.2, 2.2, and Article 3 must <br />obtain an encroachment permit from the City, which the City shall <br />issue without charge to such contractor or to the Association. <br /> <br /> 11 <br /> <br /> <br />
