13. Prior to any site work, the project developer shall post cash, letter of credit, or other <br />security satisfactory to the Planning Director in the amount of $5,000.00 for each tree to <br />be preserved should any work, utilities or otherwise, be conducted within an area in <br />which potential impacts may be anticipated. This cash bond or security shall be retained <br />for one year following acceptance of public improvements or completion of construction, <br />whichever is later, and shall be forfeited if the trees are destroyed or substantially <br />damaged. In the event any trees are destroyed or substantially damaged, an arborists' <br />assessment, at the developer's expense, shall be required to determine the damage or loss, <br />then for each damaged or destroyed tree the applicant shall plant at least two native 24" <br />box non-deciduous trees in approximately the same location, and pay the resultant value <br />of the damaged or destroyed trees, as stated in the Hortscience Report, Exhibit A, minus <br />the cost of the replacement trees, to the City's Urban Forestry Fund. <br />14. If the City Engineer determines additional grading must occur where a tree required to be <br />preserved is located, the applicant shall replace the tree with at least two native 24"-box <br />non-deciduous trees in approximately the same location and an arborists' assessment, at <br />the developer's expense, shall be required to determine the value of the tree to be <br />removed and the resultant sum, minus the cost of the replacement trees, shall be paid to <br />the City's Urban Forestry Fund. The location and species of the replacement tree shall be <br />subject to the review and approval of the Planning Director. <br />Landscaping <br />15. The proposed landscaping plan shall be that shown on page LA1 of Exhibit A. <br />16. The proposed landscaping plan shown on page LA1 of Exhibit A shall be changed as <br />noted below. The final street landscaping plan shall be subject to the review and <br />approval of the Planning Director and the City Engineer, prior to the recordation of the <br />Parcel Map and all other landscaping changes shall be subject to the review and approval <br />of the Planning Director, prior to the issuance of a building permit. <br />a. Street Landscaping <br />i. The street landscaping area on Lot 3 shall be a minimum of 10 feet in depth and <br />shall extend across the entire frontage of Lot 3, with the exception of the area <br />where the driveway is proposed. The applicant shall record a street landscaping <br />easement over this area, when recording the Parcel Map. <br />ii. The tree and shrub species in the street landscaping area shall match those along <br />Clara Lane in the "Clara Lane" subdivision by the intersection of Clara Lane and <br />Vineyard Avenue, generally PUD-99-6, PUD-99-8, PUD-99-9, PUD-99-10, and <br />PUD-99-12. <br />iii. There shall be a minimum of 6 street trees. <br />iv. The shrubs shall be spaced in a manner similar to that of the Clara Lane <br />subdivision by the intersection of Clara Lane and Vineyard Avenue, generally <br />PUD-99-6, PUD-99-8, PUD-99-9, PUD-99-10, and PUD-99-12. <br />6 <br />
