Dist. Agmt. No. 4-1080-C <br /> <br />PROJECT, in compliance with all related State and/or Federal Reg- <br />ulations. To"execute a Right of Way Certification in accordance <br />with Exhibit 09-02-01 of STATE's Right of Way Functional Hand- <br />book, Volume 9. <br /> <br /> (8) To furnish STATE with written quarterly progress <br />reports during the periods when the SERVICES are being performed. <br /> <br /> (9) To have the final maps, documents and drawings of <br />civil, structural, mechanical, electrical, architectural, or <br />other engineering features of the PROJECT prepared by or under <br />the direction of engineers or architects registered and licensed <br />in the applicable professional field in the State of California. <br />Any reports, the specifications and each sheet of plans shall <br />bear the professional seal, certificate number, registration <br />classification, expiration date of the certificate, and signature <br />of the professional engineer responsible for their preparation. <br /> <br /> (10) To advertise, award and administer the contract <br />to construct PROJECT in accordance with the requirements of the <br />State Contract Act and the California Labor Code, including its <br />prevailing wage provisions. The construction contract shall also <br />comply with-the DBE program CITY has established for those activ- <br />ities using F~deral Funds. In the event CITY has not established <br />such a program, CITY shall use STATE's process and goals. <br /> <br /> (11) Immediately following CITY's bid advertising date <br />of a construction contract for PROJECT, CITY may bill STATE for <br />ten percent (10%) of the estimated costs to construct PROJECT, <br />and to thereafter submit monthly billings for construction costs <br /> <br /> -8- <br /> <br /> <br />
