That all buildings on the subject property shall employ <br />passive and/or active solar features within their design <br />to the maximum extent feasible. <br />7. That if any fill is required for the subject site it <br />shall be transported to the property via freeways rather <br />than City streets. <br />8. That where enumerated conditions of this PUD Ordinance <br />conflict with statements on the PUD development plan, <br />the former shall control. <br />9. That a comprehensive overall signing program for the <br />entire development shall be submitted to and approved <br />by the staff prior to the issuance of a building permit. <br />10. That all walls,. driveways, parking, landscaping and <br />the exteriors of all buildings shall at all times be <br />maintained in good condition. All painted surfaces <br />shall be kept properly painted with colors approved <br />by the City. Unimproved property shall be contained <br />in a sightly condition free of weeds and debris at all <br />times. <br />11. If a building does not act as a total roof screen to <br />mechanical equipment, then any addition to the building <br />to screen present or future mechanical equipment or <br />solar collectors shall be of the same building design <br />elements and color. The use of separate mechanical <br />screen/fence design shall be discouraged with all <br />screening designed and approved at the Design Review <br />Board approval stage. <br />12. That prior to issuance of any building permits on the <br />subject property, CC&Rs shall be submitted to and <br />approved by the City Attorney. These CC&Rs shall provide <br />for a property owners association with sufficient powers <br />to manage all commonly owned areas. The City shall be <br />named as beneficiary of said CC&RS and shall be granted <br />~, the power to enforce its provisions if the property <br />'!•x'` owners association fails to do so. <br /><,:... <br />13. That because the property will be subdivided and at least <br />parts of it sold at a later date, the ordinance approving <br />PUD-81-22 or an abstract thereof, shall be recorded in <br />the office of the Alameda County Recorder so that it <br />shall be clear that all conditions of approval of this <br />case run with the land. <br />~, <br />''~ ~;'"" <br />.:.,,., <br />
