That the developer acknowledges that the City of Pleasanton <br />does not guarantee the availability of sufficient sewer <br />capacity to serve this development by approval of this <br />project and the developer agrees and acknowledges that <br />building permit approval may be withheld if sewer <br />capacity is found by the City not to be available. <br />7. That copies of the letters from David Carpenter dated <br />11/6/80 and Judd Hull dated 11/21/80 be given to all <br />prospective buyers along with the Soil and Geology <br />Investigation No. 865-A66-A5. <br />8. That all 54 conclusions and recommendations of the Soil <br />and Geology Investigation No. 865-A66-A5 of Judd Hull <br />dated 10/13/80 be complied with during construction of <br />all structures on the subject property. <br />9. That the applicant submit a plan to the City showing <br />how access and water will be maintained to the Juhl <br />property during construction of the main road; this <br />plan to be approved prior to submittal of a final sub- <br />division map. <br />10. That the owner of the parcel immediately north of lot 18 <br />shall be granted vehicular access over the Deer Oaks <br />drive if, prior to the filing of the final subdivision <br />map for subject project, said owner agrees to share the <br />prorata cost of maintaining the roadway including <br />insurance costs and gate maintenance and agrees to abide <br />by all association rules and restrictions on the use of <br />same. Said vehicular access right-of-way shall be limited <br />to one user/homeowner o£ the northerly parcel. <br />11. That as part of the tentative map approval, the exact <br />location of the road to lots 13 through 16 be established <br />showing retaining wall location, trees and how the slide <br />area is to be corrected. <br />12. That the applicant be cognizant of the fact that City <br />approval is required prior to removal of any heritage <br />size tree. <br />13. That as part of the tentative map approval a precise <br />plan for the emergency access road to lots 5, 8 and 9 <br />shall be submitted showing retaining walls, and trees <br />to be removed and pruned. <br />_ 14. That the large oak tree near the existing stable shall <br />be repaired and maintained in a healthy condition at <br />all times. <br />
