PUD-84-15 <br />12/12/84 <br />18. That all buildings and/or structures must comply with all <br />codes and ordinances in effect at the time required building <br />permits are issued by the Building Department. <br />19. That the developer shall meet all requirements of the <br />Pleasanton Fire Code. <br />20. That the site be kept free of fire hazards from the start of <br />construction to final inspection and that the Fire <br />Department emergency number shall be posted adjacent to all <br />telephones on the site. <br />21. The developer shall be responsible for the complete design <br />and construction of the off-site "Access Road" from Bernal <br />Avenue south to the proposed development with the first <br />phases of the development. This work shall be done to the <br />satisfaction of the City Engineer. The off-site street shall <br />be as generally shown on the PUD plans and the cross-section <br />of the street shall be as shown on the attached Exhibit B <br />unless otherwise approved by the City Engineer who may also <br />approve a minimum roadway width for interim use north of the <br />Eucalyptus grove with the first phase. <br />22. The developer shall be responsible for the completion of <br />Bernal Avenue (formerly Pico Avenue) from Windmill Way east <br />to the intersection of the proposed "Access Road," to the <br />satisfaction of the City Engineer, with the first phase of <br />the development. An in-lieu cash payment was deposited in <br />the City Street Improvement Fund by the developer of the <br />adjacent tract. The $41,000 in lieu payment for street <br />improvements within the north one-half of Bernal (Pico) <br />Avenue from Windmill Way east to the east boundary of Tract <br />4539, Pleasanton Hills was and is intended to cover the cost <br />of the following items remaining to be installed within that <br />area: <br />a. 19,000 sq. ft. + of structural pavement (4" A.C on 8" <br />A.B. on 9.5" A.S.B.) <br />b. 623 L.F. +_ of median island curb and revised gutter (8" <br />P.c.c.). <br />c. Minor extensions of the 10" water main, the 10" sanitary <br />sewer main, and the 15" storm drain systems, as required <br />to clear the proposed pavement area. <br />23. The developer shall use his best efforts to obtain all <br />rights-of-way needed to construct Bernal Avenue and the <br />off-site "Access Road." The City will consider using <br />condemnation procedures if all reasonable efforts fail to <br />secure the necessary rights-of-way and the developer agrees <br />to reimburse the City for right-of-way if condemnation is <br />required. <br />- 3 - <br />__ _-__..__.___T_. <br />
