PUD-84-15 <br />12/12/84 <br />9. That an irrigated landscape strip shall be established along <br />the rear property lines of lots 108 through 129 in the open <br />space area, this strip is for the purpose of providing a <br />fire break between the open space area and those lots. <br />10. That if there is commonly owned area in the project a <br />homeowners' association shall be established for the <br />development and shall be responsible for the maintenance of <br />all commonly owned areas. The CC&Rs of the homeowners' <br />association shall be submitted to the City for a review and <br />approval prior to submittal of a final map and the City shall <br />be named as third party beneficiary of the CC&Rs and granted <br />the power to enforce their provisions if the homeowners fails <br />to do so.ll. That except as modified herein, the uses and <br />site development standards for case PUD-84-15 shall be those <br />of the R-1-6500 District. <br />12. That approval of this development plan does not constitute <br />permission to remove any heritage size trees from the site. <br />Separate approval must be granted by the Director of Public <br />Works for the removal of all such trees. Where heritage <br />trees are proposed to be retained within proposed <br />development areas, plans shall be submitted to the Director <br />of Public Works detailing how these trees shall be preserved <br />in a healthy and attractive manner. The applicant shall <br />employ all measures necessary to preserve all trees shown as <br />being retained on the development plan during construction <br />on the subject property. Such measures shall include but <br />are not necessarily limited to providing barricades around <br />the trees to protect their trunks, roots and low hanging <br />branches. These barricades shall be set far enough from the <br />trees to protect them from soil compaction and excavation. <br />13. That all conditions of approval of case PUD-84-15 shall be <br />listed in the CC&Rs for the development. <br />14. That no improvement activities including, but not limited <br />to, grading, construction, tree removal, or site preparation <br />shall be initiated until all proper permits are obtained. <br />15. That there shall be access for emergency vehicles to the 6 <br />acre open space area. <br />16. That the street numbers of all homes shall be posted so as <br />to be easily seen from the street at all times, day and <br />night. <br />17. That the developer acknowledges that the City of Pleasanton <br />does not guarantee the availability of sufficient sewer <br />capacity to serve this development by the approval of this <br />case and that the developers agrees and acknowledges that <br />building permit approval may be withheld if sewer capacity <br />is found by the City not to be available. <br />- 2 - <br />
