17.36.060 <br />are not completed in a timely manner. <br />"Infrastructure" as used herein includes <br />new school construction pursuant to <br />the school financing agreement, sewage <br />treatment/export facility expansions, <br />treated water availability, traffic net- <br />work expansions consistent to imple- <br />ment city LOS policies, park procure- <br />ment/development, and other measures <br />of infrastructure/services as described <br />in the growth management reports. <br />D. No reduction in future annual new <br />residential unit limits shall affect any <br />major project or affordable housing <br />project which has received growth <br />management approval granting future <br />years' allocations so long as the condi- <br />tions in effect at the time of the initial <br />approval remain unchanged and the <br />approved project continues to meet all <br />project requirements. Nothing herein, <br />however, limits the city's ability to <br />impose a development moratorium <br />under state law. (Ord. 1729 § 2, 1997) <br />17.36.070 Apportionment Of Yearly <br />Total New Residential <br />Units To Categories Of <br />Projects: <br />All new residential units shall be <br />classified in one of the following cate- <br />gories and shall be issued building <br />permits in accordance with the regula- <br />tions and limitations established for <br />each category: <br />A. Categories Of Projects: There <br />shall be three (3) categories of projects <br />as defined below: <br />1. Affordable Housing Project: A <br />project which meets the minimum re- <br />quirements as established from time <br />to time by the city for providing hous- <br />ing to either: <br />a. Lower income households; or <br />b. Moderate income households. <br />The requirements for qualifying as <br />an affordable housing project shall be <br />established by the city in implementing <br />its affordable housing program. <br />2. Major Project: A project which <br />meets any of the following criteria: <br />a. Has one hundred (100) or more <br />units; <br />b. Has fewer than one hundred (100) <br />units but whose developer wishes the <br />certainty of a multi-year allocation of at <br />least three (3) years; <br />c. Has received an annual allocation <br />pursuant to a growth management pro- <br />gram at a time prior to the effective <br />date hereof which grants growth man- <br />agement approval to units in calendar <br />year 1998 or later years. <br />3. First-Come, First-Served Project: <br />All projects and/or single unit applica- <br />tions which are neither an "affordable <br />housing project" nor a "major project" <br />as defined in subsections Al and A2 of <br />this section. <br />B. Establishment Of Suballocations <br />For Categories Of Projects: <br />1. Affordable Housing Projects: Af- <br />fordable housing projects shall have a <br />suballocation of fifty (50) units per <br />year, beginning in 2001 and continuing <br />each year thereafter. <br />2. Major Projects And First-Come, <br />First-Served Projects: <br />a. Major projects and first-come, <br />first-served projects shall have an ini- <br />tial suballocation as set forth in the <br />following table: <br />457 (Pleasanton April 2001) <br />
