6.40.200 <br />D. Charges Based On Taximeters: <br />Except on regular long-term contractual <br />arrangements or acceptable flat rate <br />charges as described in subsection E of <br />this Section, the charges for transporta- <br />tion of passengers in taxicabs operated <br />in the City must be based on charges <br />indicated on the taximeters, and it shall <br />be unlawful for any owner, driver or <br />operator of any taxicab to charge any <br />passenger or passengers any sum in ex- <br />cess of the sum indicated on the taxi- <br />meter. <br />E. Long-Term Contractual Arrange- <br />ments Or Flat Rate Charges: <br />1. An owner, in his or her sole dis- <br />cretion, may negotiate and contract <br />with anyone for regular taxicab service <br />for an extended period of time; provid- <br />ed, that the contractual charge for each <br />trip is not in excess of the charge based <br />upon the rates established and set by <br />resolution of the City Council. Every <br />contractual service shall be recorded on <br />a manifest as described in Section <br />6.40.230 of this Chapter and shall at all <br />convenient times be open to examina- <br />tion by any authorized representative of <br />the Chief of Police so that all enforce- <br />ment personnel may be properly in- <br />formed as to the arrangement or <br />agreement. <br />2. An owner may establish a fixed <br />rate for taxicab service to a destination <br />outside the City; provided, that the <br />fixed charge for the service is not in <br />excess of the charge based upon the <br />rates established and set by resolution <br />of the City Council. Every service <br />based upon a fixed charge shall be <br />recorded on a manifest as described in <br />Section 6.40.230 of this Chapter and <br />shall be open to examination by any <br />authorized representative of the Chief <br />of Police. A copy of all fixed charges <br />and respective destination points will <br />be filed with the Chief of Police so that <br />all enforcement personnel may be prop- <br />erly informed as to the fixed charges. <br />F. Placement Of Taximeter: The taxi- <br />meter must be placed in the taxicab so <br />that the reading dial showing the <br />amount to be charged shall be well- <br />lighted and readily discernible by the <br />passenger riding in such taxicab. <br />G. Rates: It is unlawful for the owner <br />or driver of any taxicab to fix, charge, <br />collect or receive a rate in excess of <br />rates established and set by resolution <br />of the City Council. If the owner of a <br />taxicab company wishes to change the <br />rates charged, the owner shall apply by <br />letter to the City Manager stating the <br />reason for the new rates, what the pro- <br />posed new rates will be, and a current <br />survey of the rates that competitive <br />taxicab companies are charging. The <br />City Manager will then forward to the <br />City Council the request for new rates. <br />The City Council will consider the <br />proposed new rates and if deemed ap- <br />propriate will pass a resolution autho- <br />rizing the new rates. The owner of the <br />taxicab company shall then have the <br />taximeters recertified by the State Bu- <br />reau of Weights and Measures as speci- <br />fied in subsection A of this Section. <br />H. Posting Of Rate Card: There shall <br />be displayed in the passenger compart- <br />ment of each taxicab in full view of the <br />passenger a card not less than four <br />inches by six inches (4" x 6") in size <br />(Pleasanton 5-99) 1 84 <br />
