6.40.190 <br />6.40.190 Driver's Permit - Suspen- <br />sion And Revocation: <br />A driver's permit issued under the <br />provisions of this Chapter may be sus- <br />pended or revoked at any time by the <br />Chief of Police if the driver has: <br />A. Been convicted of a felony or <br />crime involving moral turpitude; <br />B. Had his or her State driver's li- <br />cense suspended, revoked, or failed to <br />maintain a valid license; <br />C. Been convicted of reckless driving <br />or driving while under the influence of <br />alcoholic beverages or drugs; <br />D. During any continuous six (6) <br />month period, had two (2) or more <br />convictions of any offense involving <br />driving; <br />E. Has submitted to a drug/alcohol <br />test in accordance with section 53075.5 <br />of the Government Code, receiving <br />positive results; or <br />F. Violates any provisions of this <br />Chapter. (Ord. 1744 § 1, 1998) <br />6.40.200 Operating Requirements: <br />A. Taximeter Required: It is unlaw- <br />ful for any owner or driver to operate <br />any taxicab in the City unless such <br />vehicle is equipped with a taximeter of <br />such type, style and design as may be <br />approved by the Chief of Police. It <br />shall be the responsibility of every <br />owner operating a taxicab to keep such <br />taximeter in perfect condition so that <br />said taximeter will, at all times, correct- <br />ly and accurately indicate the correct <br />charge for the distance traveled and <br />waiting time. The taximeter shall be <br />certified by having a certification stick- <br />er affixed by the State Bureau of <br />Weights and Measures, which has the <br />sole authority to certify such meters. <br />B. Registration Of Fares: Every taxi- <br />meter shall register the charge to the <br />nearest ten cents ($0.10) and be <br />equipped with a flag or other mechani- <br />cal device with the words "For Hire" <br />printed or stamped thereon, and the flag <br />shall be so attached and connected to <br />the mechanism of the taximeter as to <br />cause the mechanism to operate when <br />the flag is in a position other than <br />upright and indicate that the taxicab is <br />not for hire, and which said flag shall, <br />when moved forward or downward, <br />start the operation of the taximeter so <br />that the same will operate in the man- <br />ner defined in this Section. <br />C. Unlawful Display Of Flag: Except <br />on regular long-term contractual ar- <br />rangements or acceptable flat rate <br />charges as described in subsection E of <br />this Section, it is unlawful for any <br />driver of a taxicab while carrying pas- <br />sengers to display the flag or device <br />attached to such taximeter in such a <br />position as to denote that such vehicle <br />is for hire, or is not employed, or to <br />have such flag or other attached device <br />in such a position as to prevent the <br />taximeter from operating. It is unlawful <br />for any driver to throw such flag or <br />other device of a taximeter into a posi- <br />tion which causes the taximeter to <br />record when such vehicle is not actual- <br />ly employed, or fail to throw the flag or <br />other device on such taximeter into a <br />nonrecording position at the termination <br />of each and every service. <br />183 (Pleasanton 5-99) <br />
