6.60.030 <br />Each homeowner will be sent a ballot <br />with candidates from that homeowner's <br />park. The candidate from the Vineyard <br />Mobile Villa and from the Hacienda <br />Mobilehome Park receiving the largest <br />number of votes shall serve on the <br />PMC until their successors are elected. <br />The candidate from the Fairview Trailer <br />Park and the Pleasanton Mobilehome <br />Park receiving the largest number of <br />votes shall serve as the alternate. <br />C. Park Owner Members: Two (2) <br />regular members of the PMC shall be <br />park owners or their designated repre- <br />sentatives. The park owners shall by <br />majority vote designate their two (2) <br />members and if only one or no person <br />receives a majority vote, then members <br />shall be designated by lot from among <br />the park owners. <br />D. Fifth Member: The fifth regular <br />member of the PMC shall be selected <br />by the other four (4) members. <br />E. Meetings: The PMC shall meet as <br />necessary to organize itself, establish a <br />mechanism for keeping minutes of its <br />meetings, establish rules for conducting <br />its business, and determine when it will <br />meet. Minutes of the meetings shall be <br />prepared. <br />F. Jurisdiction: Except for matters <br />concerning fair return adjustments, base <br />year rent adjustments and service re- <br />ductions, Sections 6.60.070 to 6.60.120 <br />of this Chapter, the PMC shall have the <br />power to make decisions on any matter <br />relative to this Chapter which is not <br />preempted by State law. <br />G. Limitation On Authority: In mak- <br />ing its decision, the PMC shall act in <br />good faith and shall not make any <br />decision which could cause substantive <br />changes in the operation of a park or <br />adversely affect the value of the park. <br />Nothing in this Section is intended to <br />abridge the right of the park owner to <br />manage his/her park in a reasonable <br />manner. (Ord. 1701 § 1, 1997; Ord. <br />1588 § 1, 1993) <br />6.60.040 Petition Process Other <br />Than Fair Return Adjust- <br />ment, Base Year Rent <br />Adjustment, And Service <br />Reduction Petitions: <br />A. Initiation Of Petition: The PMC <br />may meet on an issue or issues of inter- <br />est to a homeowner or a park owner. <br />The request must be on a petition but <br />does not require any particular number <br />of signatures beyond that of the peti- <br />tioner. The petition must identify the <br />problem(s) to be addressed by the PMC <br />and may recommend a solution. <br />B. Prerequisite To Petition: The <br />PMC may consider a petition that in- <br />volves aspecific park but the petition <br />may be considered by the PMC only <br />after the following events have oc- <br />curred: <br />1. The petitioner has submitted the <br />issue in writing to the park owner. <br />2. A satisfactory resolution of the <br />issue has not been achieved within <br />thirty (30) days from the written sub- <br />mittal. <br />C. PMC Action: The PMC shall hold <br />as many hearings on a petition as it <br />deems appropriate given the subject <br />matter of the petition.
