6.60.040 <br />ten decision within ten (10) days of its <br />decision. <br />D. Appeal From PMC Action: Any <br />decision of the PMC may be appealed <br />to the City Manager, provided the ap- <br />peal is filed within thirty (30) days of <br />the decision. The City Manager shall <br />designate an impartial arbitrator who <br />shall have the same jurisdiction and <br />authority as the PMC unless the parties <br />stipulate otherwise. The costs of arbi- <br />tration shall be split equally between <br />the affected park owner, the affected <br />home owner or Home Owner's Associa- <br />tion, and the City. (Ord. 1701 § 1, <br />1997; Ord. 1588 § 1, 1993) <br />6.60.050 Capital Improvement <br />Costs: <br />A. Capital Improvements; Amortiza- <br />tion: If a park owner constructs new <br />capital improvements as provided in <br />subsection F of this Section, the park <br />owner shall amortize the costs as pro- <br />vided in this Section. In addition, if a <br />park owner rehabilitates or replaces any <br />existing capital improvements, a park <br />owner shall amortize as provided in this <br />Section only the difference between the <br />original cost of the capital improvement <br />and the cost to rehabilitate or replace <br />the capital improvement. Capital im- <br />provement costs shall not be amortized <br />unless as to parks with fifty (50) or <br />more spaces they exceed five thousand <br />dollars ($5,000.00) and as to parks with <br />fewer than fifty (50) spaces, they ex- <br />ceed one thousand dollars ($1,000.00). <br />Capital improvement costs are to be <br />calculated on an improvement-by-im- <br />provement basis and not collectively, <br />although costs can be accumulated for <br />the same capital improvement over a <br />twelve (12) month period. Any costs as <br />to any particular capital improvement <br />that are under the threshold amounts <br />($5,000.00/$1,000.00) shall not be <br />amortized but shall be used by a park <br />owner using Formula B to calculate <br />rent increases. <br />B. Amortization Periods For Parks <br />With Fifty Or More Spaces: For any <br />park with fifty (50) or more spaces, the <br />capital improvement amortization peri- <br />ods shall be as follows: <br />$ 5,000.00 - $ 9,999.00 2 years <br />10,000.00 - 14,999.00 3 years <br />15,000.00 - 19,999.00 4 years <br />20,000.00 - 29,999.00 5 years <br />30,000.00 - 39,999.00 6 years <br />40,000.00 - 49,999.00 7 years <br />50,000.00 + 8 years <br />C. Amortization Periods For Parks <br />With Less Than Fifty Spaces: For any <br />park with less than fifty (50) spaces, <br />the capital improvement amortization <br />periods shall be as follows: <br />$ 1,000.00 - $ 2,499.00 2 years <br />2,500.00 - 4,999.00 3 years <br />5,000.00 - 8,999.00 4 years <br />9,000.00 - 13,999.00 5 years <br />14,000.00 - 19,999.00 6 years <br />20,000.00 - 29,999.00 7 years <br />30,000.00 + 8 years <br />D. Financing Costs: If the capital <br />improvement costs are amortized, the <br />park owner may include reasonable <br />192-43 (Pleasanton 5-98) <br />
