6.04.010 <br />Chapter 6.04 <br />AMUSEMENT DEVICES <br />Sections: <br />6.04.010 Definition <br />6.04.020 Free Games <br />6.04.030 Bingo Machines <br />6.04.040 Standards <br />6.04.010 Definition: <br />As used in this chapter, the following <br />word shall have the meaning given: <br />A. "Amusement device" means any <br />machine, apparatus, appliance or device <br />now or in the future known which may be <br />operated or played upon, and as a result <br />of the play, action or operation of such <br />machine, apparatus, appliance or device, <br />whether by skill or by chance, a score or <br />result of such play, action or operation is <br />in any way recorded, exhibited or made <br />known, including, but not limited to, tape <br />machine, cazd machine, mazble game <br />machine, horseracing machine, football <br />game machine, basketball game machine, <br />baseball game machine, pool game ma- <br />chine, video game machine, or any other <br />similaz machine or device. (Ord. 1072 <br />§ 1, 1983; Prior Code § 4-4.22) <br />6.04.020 Free Games: <br />It is unlawful for any person to keep or <br />use in any public place any amusement <br />device equipped with any mechanism <br />which cancels and records the cancella- <br />tion of free games won without the play- <br />ing of the free games by the player. (Ord. <br />1072 § 1, 1983; Prior Code § 4-4.23) <br />6.04.030 Bingo Machines: <br />It is unlawful for any person to keep or <br />use in any public place any amusement <br />device of a type commonly known as a <br />"bingo" type or "in-line" type or a type <br />wherein the winner of a game or games is <br />achieved by the placing of balls into holes <br />or cups in such a manner as to activate, <br />record or light up figures or numbers on a <br />scoreboazd so as to record a series of <br />numbers in any contiguous, horizontal, <br />vertical or diagonal straight line similaz to <br />a bingo game score. (Ord. 1072 § 1, <br />1983; Prior Code § 4-4.24) <br />6.04.040 Standards: <br />Amusement devices in public places <br />shall be maintained in accord with the <br />standazds set forth in this section. These <br />standazds shall be conspicuously posted in <br />all places where amusement devices are <br />available to the public: <br />A. Amusement devices authorized in <br />"game arcades", as defined in section <br />18.08.207 of this code, shall be operated <br />in accord with conditions of required <br />conditional use penrnits. <br />B. All amusement devices in public <br />places shall be under the direct line of <br />sight supervision of an employee on the <br />premises responsible for the operation of <br />the devices at all times. <br />C. All provisions of the uniform fire <br />code as administered by the city with <br />regazd to aisle width dimensions and cleaz <br />and free access to and through azeas used <br />by the public shall be observed at all <br />times in conjunction with the operation of <br />amusement devices. <br />D. Bicycle racks shall be provided at <br />locations so as to be reasonably available <br />135 (Pleasanton January 2004) <br />
