20.16.050 <br />records of the public works department <br />of the city and a signed copy furnished <br />the applicant. The granting of any vari- <br />ance shall not be construed to imply or <br />fix any liability on the part of the city <br />or any officer or employee thereof for <br />any damages to persons or property by <br />reason of such variances. (Ord. 1869 <br />§ 4, 2002; Ord. 1393 § 2, 1989; Prior <br />Code § 2-14.35) <br />20.16.060 Section 110.1 Amended - <br />Appeals: <br />Section 110.1 of the California <br />Building Standards Code 2001 Edition, <br />(24 C.C.R.), and including by reference <br />the Uniform Mechanical Code, 2000 <br />Edition is amended as follows: <br />110.1 Appeals: Whenever the Chief <br />Building Official shall disapprove an <br />application or refuse to grant a per- <br />mit applied for, or when it is claimed <br />that the provisions of the code or this <br />Chapter do not apply or that the true <br />intent or meaning of the code has <br />been misconstrued or wrongly inter- <br />preted, the applicant may appeal <br />from the decision of the Chief Build- <br />ing Official to the City Manager <br />within thirty (30) days from the date <br />of the decision appealed. Such appeal <br />shall be in writing and the City Man- <br />ager shall within thirty (30) days of <br />the receipt of the appeal and by <br />written notice to the appellant either <br />uphold, reverse or modify the deci- <br />sion of the Chief Building Official. <br />The decision of the City Manager <br />may be appealed within thirty (30) <br />days of said decision to the Board of <br />Appeals established by Section <br />20.16.070 of this Chapter. <br />(Ord. 1869 § 4, 2002; Ord. 1393 § 2, <br />1989; Prior Code § 2-14.36) <br />20.16.070 Board Of Appeals - <br />Established: <br />There is created and established a <br />board of appeals consisting of five (5) <br />members. Each member of the board of <br />appeals shall be appointed by the coun- <br />cil for a term of two (2) years; provid- <br />ed, that the first two (2) members ap- <br />pointed shall serve a term of one year. <br />The board shall elect a chairman. The <br />chief building official or his representa- <br />tive shall be an ex officio member of <br />said board and shall serve as secretary. <br />The board shall adopt reasonable rules <br />and regulations for conducting its busi- <br />ness. Any board of appeals appointed <br />by the city council under the provisions <br />of any other ordinance may act as the <br />board of appeals provided for in this <br />chapter when so directed by resolution <br />of the city council. (Ord. 1869 § 4, <br />2002; Ord. 1393 § 2, 1989; Prior Code <br />§ 2-14.37) <br />20.16.080 Board Of Appeals - <br />Duties: <br />The board of appeals shall: <br />A. Upon receipt of a written notice <br />of appeal from the decision of the city <br />manager by the owner or party in inter- <br />est within thirty (30) days of the date <br />of the service of said decision or order, <br />the board shall entertain such appeal <br />and conduct a hearing thereon as pro- <br />vided in subsection B of this section. <br />(Pleasanton April 2003) '] 10_2, <br />
