The granting of any vari- ance shall not be construed to imply or fix any liability on the part of the city or any officer or employee thereof for any damages to persons or property by reason of such variances. (Ord. 1869 § 4, 2002; Ord. 1393 § 2, 1989; Prior Code § 2-14.35) 20.16.060 Section 110.1 Amended - Appeals: Section 110.1 of the California Building Standards Code 2001 Edition, (24 C.C.R.), and including by reference the Uniform Mechanical Code, 2000 Edition is amended as follows: 110.1 Appeals: Whenever the Chief Building Official shall disapprove an application or refuse to grant a per- mit applied for, or when it is claimed that the provisions of the code or this Chapter do not apply or that the true intent or meaning of the code has been misconstrued or wrongly inter- preted, the applicant may appeal from the decision of the Chief Build- ing Official to the City Manager within thirty (30) days from the date of the decision appealed. Such appeal shall be in writing and the City Man- ager shall within thirty (30) days of the receipt of the appeal and by written notice to the appellant either uphold, reverse or modify the deci- sion of the Chief Building Official. The decision of the City Manager may be appealed within thirty (30) days of said decision to the Board of Appeals established by Section 20.16.070 of this Chapter. (Ord. 1869 § 4, 2002; Ord. 1393 § 2, 1989; Prior Code § 2-14.36) 20.16.070 Board Of Appeals - Established: There is created and established a board of appeals consisting of five (5) members. Each member of the board of appeals shall be appointed by the coun- cil for a term of two (2) years; provid- ed, that the first two (2) members ap- pointed shall serve a term of one year. The board shall elect a chairman. The chief building official or his representa- tive shall be an ex officio member of said board and shall serve as secretary. The board shall adopt reasonable rules and regulations for conducting its busi- ness. Any board of appeals appointed by the city council under the provisions of any other ordinance may act as the board of appeals provided for in this chapter when so directed by resolution of the city council. Upon receipt of a written notice of appeal from the decision of the city manager by the owner or party in inter- est within thirty (30) days of the date of the service of said decision or order, the board shall entertain such appeal and conduct a hearing thereon as pro- vided in subsection B of this section.
