20.16.020 <br />20.16.020 Added -Section 111.2 <br />Penalties: <br />Section 111.2 of the California <br />Building Standards Code 2001 Edition, <br />(24 C.C.R.), and including by reference <br />the Uniform Mechanical Code, 2000 <br />Edition, is amended as follows: <br />111.2 Penalties. Penalties for viola- <br />tions will be as provided in Section <br />1.12.020 of the Pleasanton Municipal <br />Code. <br />(Ord. 1869 § 4, 2002; Ord. 1778 § 4, <br />1999; Ord. 1169 § 6, 1984; Prior Code <br />§ 2-14.29) <br />20.16.030 Section 108.1 Amended - <br />General: <br />Section 108.1 of the California <br />Building Standards Code 2001 Edition, <br />(24 C.C.R.), and including by reference <br />the Uniform Mechanical Code, 2000 <br />Edition is amended as follows: <br />108.1 General. This Chapter and the <br />adopted Uniform Mechanical Code <br />shall be enforced by the Chief Build- <br />ing Official of the City acting either <br />directly or through properly autho- <br />rized agents acting within the scope <br />of the particular duties delegated to <br />them by the Chief Building Official; <br />for such purpose the Chief Building <br />Official or his agent shall have the <br />power of a police officer. <br />The Chief Building Official shall <br />have the power to render interpreta- <br />tions of this code and to adopt and <br />enforce rules and regulations supple- <br />mental to this code as may be <br />deemed necessary in order to clarify <br />the application of the provisions of <br />this code. Such interpretations, rules <br />and regulations shall be in conformi- <br />ty with the intent and purpose of this <br />code. <br />The language used in this Code is <br />intended to convey the common and <br />accepted meaning familiar to the <br />heating, venting and comfort cooling <br />industry to determine the intent and <br />meaning of any provision of this <br />Chapter. Such determinations shall <br />be made, in writing, and a record <br />shall be kept in the office of the <br />Department of Public Works, which <br />record shall be available to interested <br />parties. <br />(Ord. 1869 § 4, 2002; Ord. 1393 § 2, <br />1989; Prior Code § 2-14.33) <br />20.16.040 Interpretation: <br />(Rep. by Ord. 1869 § 4, 2002) <br />20.16.050 Variances: <br />The chief building official shall have <br />the power to grant a variance to any of <br />the provisions of the adopted uniform <br />mechanical code upon application, in <br />writing, by the affected party or his <br />duly authorized agent, when there are <br />practical difficulties in the way of car- <br />rying out the strict letter of the code; <br />provided, that the spirit of the code <br />shall be observed, public health, safety <br />and welfare secured and substantial <br />justice done. The particulars of such <br />variance and the decision of the chief <br />building official shall be entered in the <br />710-1 (Pleasanton April 2003) <br />
