20.16.080 ,..` The board of appeals shall notify the owner or parties in interest of the hear- ing date, post the property with a notice of hearing and publish a notice of hear- ing, all as provided in this chapter. B. Hold a hearing as required by subsection A of this section, within twenty one (21) days after receipt of appeal, to hear such testimony as may be presented by any department of the city or the owner, occupant, mortgagee, lessee or any other person having an interest. C. Make written findings of fact within sixty (60) days of the date of first hearing. D. The board shall uphold, reverse or modify the city manager's decision. (Prior Code § 2-14.38) 20.16.090 Notification: A notice given by the board of ap- peals shall be served personally or be sent by registered or certified mail, postage prepaid, return receipt request- ed, to the person owning the land on which the building or structure is lo- cated, as such person's name and ad- dress appear on the last equalized as- sessment roll, and to a mortgagee or beneficiary under any deed of trust of record, at the last known address of such mortgagee or beneficiary; pro- vided, that if the whereabouts of such persons are unknown and the same can- not be ascertained by the chief building official in the exercise of reasonable diligence and the chief building official shall make an affidavit to that effect, then said notice shall be served by publishing same once each week for two (2) consecutive weeks in a newspa- per published in the city and by posting said notice on the property prior to the date of first publication. Such notice shall contain, among other things, the following information: A. Name of owner or other persons interested, as provided in this section; B. Street address and legal descrip- tion of the property on which such a building or structure is located; C. A general description of the mat- ter which is being appealed; D. The owner's right of appeal to the city council. (Ord. 1869 § 4, 2002; Ord. 1393 § 2, 1989; Prior Code § 2-14.39) 20.16.100 Appeal To Council: A. Any person aggrieved or alleging error by the action of the board of appeals in the administration or en- forcement of this chapter may make application to the city clerk in the manner prescribed by the city council within seven (7) days from the date of the action that is appealed. B. Application shall be accompanied by a verification by at least one of the petitioners, attested before a notary public or person authorized to adminis- ter oaths, or by a sworn declaration under penalty of perjury. C. A public hearing shall be held by the city council within thirty (30) days from the date of the appeal. Notice of time, place and purpose of the hearing shall be given by the city clerk by publication once in a newspaper of general circulation published within the city limits at least ten (10) days prior to said hearing. 710-3 (Pleasanton April 2003)
