Should the City Manager and Collector be unable to agree on <br />a corrective action plan, the City Council will make the final <br />decision subject to appropriate judicial review. <br />21.2 Acts of God or acts of other persons or <br />combinations thereof over which the Collector does not have <br />control are not subject to complaint as matters of unsatisfactory <br />or failure of performan ce by Collector. The Collector is <br />responsible to show evidence of these conditions to the <br />satisfaction of the City. <br />SECTION 22 - TECHNOLOGICAL IMPROVEMENTS <br />Both parties to this Agreement fully understand that, during the <br />term of this Agreement, technological improvements will become <br />available in the field of solid waste disposal which are not now <br />available. Both parties agree that every effort will be made in <br />order to implement and take advantage of such technological <br />improvements, including those related to recycling and waste <br />disposal. <br />Further, both parties to this Agreement fully understand that <br />changes may be proposed relative to governmental regulatory <br />requirements pertaining to solid waste disposal management <br />during the term of this Agreement. The Collector fully <br />understands and agrees that the City will proceed to consider, <br />22. <br />
