<br /> <br />Upon motion of Commissioner Arnold, seconded by Commissioner Garrigan, and <br />carried, the Public Hearing was closed. <br />Commissioner Arnold felt that the developer should not be permitted to negotiate <br />and renegotiate the P.U.D., and would like to see some definite clarification <br />from the City Attorney on the maintenance of the common green areas and codes <br />and covenants thereto. <br />Both Commissioners Garrigan and Gibbs felt that more information on this matter <br />would be necessary before a decision could be reached, and would prefer to wait <br />as there was 60 days from the date of the hearing to do this. <br />Commissioner Antonini also felt that clarification should be made on the mainte- <br />nance and the codes and covenants attached to the common green areas and a report <br />from the City Attorney on them; also that the amending of a P.U.D. within a <br />P.U.D. was alarming. Commissioner Antonini felt that they should take a stand <br />on this matter. <br />Basipally, Chairman Plato agreed with these ideas as expressed by the remainder <br />of the Commission. <br />Upon motion of Commissioner Garrigan, seconded by Commissioner Arnold, and carried, <br />the following resolution was unanimously adapted. <br />RESOLUTION N0. 877 <br />WHEREAS, the application of Amador Valley Investors for <br />a zone change amendment from an R-1 (Single <br />Family) District to a P.U.D. (Planned Unit <br />Development) District a portion of Parcels 2-6 <br />and 6-2, Assessor's Map Book 946, Block 1101, <br />ea id properties containing approximately 11.0 <br />acres, has come before this Commission, <br />NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the <br />City of Pleasanton hereby continues this item <br />until such time as the applicant provides <br />complete data on the codes and covenants <br />governing the maintenance of the com<son green <br />areas. <br />c. Article 17 - Sians <br />Resolution to amend Zoning Ordinance No. 520 regarding the prohibiting of A-board <br />signs. (Continued from March 12, 1969) <br />The City Attorney requested a continuance, which was acceptable to the Commissioners. <br />6. PUBLIC HEARINGS - NEW BIISINESS <br />a. UP-69-7. Htmtble Oil Comoanv <br />Application for a Conditional Use Permit in a C-N (Commercial Neighborhood) <br />District to allow the erection and operation of an Enco service station on that <br />property described ae a portion of Lot ~2, Tract #2639, Assessor's Map Book #53, <br />Pages 38-44, containing .9 acres, more or leas, or more commonly known as the <br />southeast corner of Santa Rita Road and West Las Positas Boulevard. <br />Chairman Plato opened the Public Hearing. Acting Secretary Aiello read the <br />staff report. Also requested some direction from the Commissioners regarding <br />deviation from the normal method of service station site planning and orientation. <br />Mr. George Oakes showed the elevation plans of the service station they are <br />proposing for Humble Oil, and explained the concept for the rest of the shopping <br />center, of which the service station was planned to be the first phase. <br />Mr. Oakes was in opposition to the staff report. There was considerable dis- <br />cussion between the applicant, the City staff and the Commissioners regarding <br />the feasibility of putting service stations traditionally at corner sites, and <br />particularly in this case because of the proposed Fire Station in close enough <br />proximity as to possibly cause difficulty in maneuverability of the fire trucks <br />in emergencies. <br />- 3 - <br />
