~- <br /> <br />Chairman Plato opened the Public Hearing. Mr. Castro read the staff report, <br />concluding with the recommendation that the application be approved. <br />Chairman Plato asked a question regarding the property when it was first annexed <br />he remembers there was a condition that the shopping center across the street <br />could not begin construction until 500 single-family homes had been constructed. <br />This was clarified to be a condition for the commercial across the street. A <br />check had been made of the number of homes constructed to date, and the number <br />is 477 homes. <br />Mr. Per Perry, the representative for Shell Oil Company, was in the audience and <br />concurred with the staff report. He clarified one point, that the staff report <br />showed .92 acres for the site. In actuality, the site is .684 acres after <br />dedication of street improvements. <br />There being no further comments, upon motion of Commissioner Carrigan, seconded <br />by Commissioner Arnold, and carried, the Public Hearing was closed. <br />There was considerable discussion between the Commissioners and Mr. Perry <br />interjected a request that Shell Oil would like to retain the emergency tow <br />service. This the Commissioners objected to. <br />Upon motion of Commissioner Carrigan, seconded by Commissioner Gibbs, and carried, <br />the following resolution was adopted unanimously. <br />RESOLUTION N0. 902 <br />WHEREAS, the application of Shell Oil Company for a <br />conditional use permit to allow the erection <br />of a service station on a portion of Parcel 3, <br />Assessor's Map Book 941, Block 1300, or more <br />commonly known as the southwest corner of <br />Hopyard Road and West Las Positas Boulevard, <br />containing .684 acres, more or leas, has come <br />before this Commission, <br />NOW, THEREFORE BE IT RESOLVED Yhat UP-69-11 be approved subject <br />to the following cord itions: <br />1. That the permit is granted for .the property as <br />described in the application and any attachment <br />thereto, and as shown on the attached plan labeled <br />Exhibit A. <br />2. That 10-ft. commercial sidewalk with street tree <br />pockets be constructed along the entire street <br />frontage of the subject property as directed by the <br />City Engineer. <br />3. 74iat the driveway approaches be constructed to <br />City standards and located as directed by the City <br />Engineer. <br />4. That the lighting of the station and site, <br />especially the canopies, be designed so as to <br />eliminate the objectionable glare that is typical <br />of new Shell stations. <br />5. That the developer provide street lights on <br />Hopyard Road as directed by the City Engineer. <br />6. That trailer rentals, auto towing facilities <br />and equipment and other nonrelated services shall <br />be prohibited on said premises. Said condition <br />is hereby applicable to the property owner and to <br />the lessee of said property. <br />7. That approval of the site plan, landscaping and <br />exterior materials and revisions shall be subject <br />to the Design Review Board. <br />- 6 - <br />
