<br /> <br />Upon motion of Commissioner Arnold, seconded by Commissioner Carrigan, and <br />carried, the Public Hearing was closed. <br />Upon motion of Commissioner Arnold, seconded by Commissioner Gibbs, and carried, <br />the following resolution was adopted unanimously. <br />RESOLUTION N0. 901 <br />WHEREAS, the application of Fred Hanscom to allow the <br />operation of a fix-it shop to engage in the <br />parts, service and sale of lawnmowers, pumps, <br />motors, heaters, small appliances, bicycle <br />repair, and any other products and/or service <br />related at that address known as 608 Main Street <br />in a C-C District, has come before this <br />Commission, <br />NOW, THEREFORE BE IT RESOLVED that Z-69-38, be approved subject <br />to the following conditions: <br />1. Record owner of the property to enter into an <br />agreement with the City of Pleasanton to provide <br />additional parking to serve the owner's land by <br />exercising discretion as follows: <br />a. Cooperate with the City and civic organizations <br />in establishing parking lots to serve the Central <br />Business District, <br />b. Withhold any protest to assessment districts <br />initiated by the City to finance parking facilities <br />for the Central Business District. <br />2. Record owner of the property to enter into an <br />agreement with the City of Pleasanton to agree <br />to demolish building at such time as the lease <br />with the dress shop terminates, or agree to bring <br />the building fully up to Code. <br />3. Building to be brought up to Building Code <br />requirements as established by the Building Inspector <br />prior to occupancy. Such work to be required to <br />include but not be limited to the following: <br />a. Lock out use of upper story (this is a must) <br />b. Exit signs shall be installed with 5-in. letters <br />to instruct customers to use the rear door exit in <br />case of emergency. <br />c. Install fire extinguishers as directed by Fire <br />Chief. <br />4. Weeds to be removed from rear portion of property. <br />5. Review of driveway easement by the City Attorney. <br />e. UP-69-11, Shell Oil Comoanv <br />Application for a conditional use permit to allow the erection of a service <br />station on a portion of Parcel 3, Assessor's Map Book No. 941, Block 1300, or <br />more commonly known as the southwest corner of Hopyard Road and West Las Poaitas <br />Boulevard, containing .92 acres, more or less, in a C-N District. <br />- 5 - <br />
