f~ ~ <br />6. NEW BUSINESS - PUBLIC HEARINGS. <br />a. UP-69-15. Humble Oil and Refining Comoanv <br />Application to allow the erection of an automotive service station on that <br />property described as the southwest quadrant of Interstate #580 and Hopyard <br />Road containing 1.0 acres, more or leas, in an I-G (General Industry) District. <br />Vice Chairman Pons opened the Public Hearing. The Planning Director stated <br />that the staff is still of the same opinion that there are too many service <br />stations being proposed for the interchange of Hopyard Road and Interstate #580, <br />and that denial was recommended. <br />As background information, this particular application while still in the <br />County, had been issued a building permit which subsequently expired before <br />construction had begun. <br />Vice Chairman Pons inquired about the study of service station sites to be <br />conducted by the staff. This had not been completed yet, however, Mr. Castro <br />verbally informed the Commissioners that based on development plans submitted <br />by various developers, there appears to be 10 service station sites proposed <br />for Hopyard Road. <br />Mr. Don Kallenberg, representing Humble Oil Company, spoke in favor of the <br />application and stated that if the only basis for the recommendation of denial <br />by the staff is the number of service station sites proposed for Hopyard Road, <br />then he felt it was highly questionable that this use permit can be denied <br />on that basis. Mr. Kallenberg then went on to provide briefly the history <br />behind their acquisition of this piece of property, and that Humble Oil has <br />been the owner of that property since 1967. <br />If this service station is granted, it will make a total of three stations for <br />this particular interchange - Humble Oil, Mobil and Shell Oil. <br />Commissioner Antonini reminded the applicant that a service station is always <br />a conditional use in any district, and that he felt the City of Pleasanton <br />had no obligation to honor a permit granted by Alameda County when the property <br />was under that jurisdiction. <br />Commissioner Gibbs feels that the applicant's presentation is quite valid. <br />A couple of other service station applications in the recent past have received <br />approval. Since approval was given on the others, this application should not <br />also be denied. He feels that Humble Oil purchased the property in good faith <br />for just that use and that they should not be denied. Commissioner Antonini <br />disagreed with this trend of thought. He felt that the study by the staff should <br />be completed and that he could not make a decision on this application that <br />evening until the staff had presented more direction to the Commission. <br />The City Attorney expressed his views that to him it was quite clear that since <br />the City now had jurisdiction on the property, its right to control it should <br />not be questioned. <br />Vice Chairman Pona stated that he did not want to be a party to making Hopyard <br />Road or any other area a "gasoline alley." In fairness to all concerned, he <br />feels more checking into the land sites ahou8d be done. Perhaps a work session <br />might be the answer. <br />Commissioner Gibbs agreed and felt that the staff should get into this "hard and <br />heavy" because in all fairness to Humble Oil, this "should be done and done in <br />a hurry." <br />Upon motion of Vice Chairman Pons, seconded by Commissioner Gibbs, and carried, <br />the Public Hearing was continued. <br />- 2 - <br />
