Box 520 <br />Pleasanton CA 94566 <br /> <br /> A G R E E M E N T <br /> <br /> THIS AGREEMENT is made and entered into on the day <br /> <br />of , 19__, by and between NOLAN DAVIS and <br /> <br />VELIA DAVIS, (hereinafter referred to as "Owners") and the <br />CITY OF PT~ASANTON, a municipal corporation, 123 Main Street, <br />Pleasanton, California (hereinafter referred to as "City'). <br />The City and Owners agree as set forth below. <br /> <br /> W I T N E S S E T H: <br /> <br /> WHEREAS, Owners are the owners of real property in the <br />City of Pleasanton described in Exhibit "A", attached to this <br />agreement and made a part of it by reference, which consists <br />generally of 3.63 acres located at the southeast intersection <br />of Santa Rita Road and Pimlico Drive (hereinafter referred to <br />as the "project site"); and <br /> <br /> WHEREAS, Owners have received conditional approval for <br />Planned Unit Development No. 80-15-5D, (hereinafter referred <br />to as "subject project"); and <br /> <br /> WHEREAS, among the conditions of approval for the <br />subject project are that the Owners shall enter into the <br />following Agreements: <br /> <br /> o Agreement to create an assessment district or <br /> districts for the construction of the facilities <br /> necessary to ameliorate traffic congestion caused <br /> by development of the subject project. <br /> <br /> -1- <br /> <br /> <br />
