City further agrees not to preclude construction of <br /> permanent _improvements. by Owner or its agent except upon and <br /> within the easement herein and shall not impose any <br /> additional zoning setback or "clear area" insofar as the <br /> construction of improvements is concerned back or away from <br /> either edge of said easement. <br /> <br /> 3. Owner Obligation. Owner agrees to dedicate to the <br /> <br />City for no monetary consideration the property needed for a <br />twenty foot (20~) wide public service easement for public <br />utilities more particularly described in Exhibit "A" <br />attached hereto and incorporated herein by this reference. <br /> <br /> 4. Attornev~s Fees. In the event that litigation is <br /> <br />necessary to enforce the provisions hereof, the prevailing <br />party shall be entitled to reasonable attorneyts fees and <br />court costs incurred in connection therewith. <br /> <br /> 5. Notices. All notices herein required shall be in <br /> <br />writing and delivered in person or sent by certified mail, <br />postage prepaid.
