In the event that either City or Owner <br /> <br />shall at any time or times waive any breach of this agreement <br />by the other, such waiver shall not constitute waiver of any <br />other or succeeding breach of this agreement, whether of the <br />same or any other covenant, condition or obligation. <br /> <br /> 7. Binding on Land and successors. All covenants, <br /> <br />promises and agreements contained in this agreement shall <br />pertain to and do hereby expressly run with the land <br />controlled by Owner and described herein. This agreement <br />shall bind and inure to the parties hereto, including heirs, <br />assigns, executors, administrators, and all other parties <br />whether they succeed by operation of law or voluntary acts of <br />Owner. Signatures and execution of all parties shall be <br />acknowledged before a Notary Public. The City shall record <br />this agreement with the Recorder of Alameda County. <br /> <br /> <br />
