Agenda, noting on the Agenda what has been published, in order to avoid <br />the delay in bringing such items before the Conunission. <br />On motion of Conuaissioner Landon, seconded by Commissioner <br />Antonini, the following resolution was unanimously adopted: <br />Resolution No. 162 <br />WHEREAS, this Commission finds that the ten (10) day waiting period <br />for publishing requests for Variances, Conditional Use <br />Permits, Rezoning, etc. prior to the Public Hearing before this <br />Commission has created a delay ir. bringing these matters before the <br />Commissions and <br />WHEREAS, it is the opinion of this Commission that authorization to <br />the Staff to publish such items as soon as application is <br />made, provided such publication is noted on the Commission's Agenda, <br />would avoid said delay; <br />NOW, THEREFORE, BE IT <br />RESOLVED, that this Commission does hereby authorize the members of <br />the Staff to publish requests for Variances, Conditional <br />Use Permits, Rezoning, etc. at the time application is made, noting <br />such publication on the Agenda, in order to avoid any delay in the <br />Public Hearings before this Commission. <br />Secretary Fales read the proposed amendments to Ordinance No. <br />309 regarding blast and fallout shelters, and, on motion by <br />Commissioner Antonini, seconded by Conffnissiouer Rega, the following <br />resolution was unanimously adopted: <br />Resolution No. 163 <br />WHEREAS, this Commission has discussed certain changes to Ordinance <br />No. 309 regarding blast and fallout shelters; and <br />WHEREAS, it has been decided that said changes would be beneficial; <br />NOW, THEREFORE, BE IT <br />RESOLVED, that the following proposed Amendments to Ordinance No. <br />309 be reconm~ended by this Corslission for adoption by <br />the City Council: <br />a. All shelters constructed within the i'ront yard set- <br />back must be underground with no change in the exist- <br />ing grade. No setback is required for the structure. <br />b. Protrusions from shelters constructed within the front <br />yard setback must maintain a 5 foot setback and may not <br />protrude above 30 inches in height from the existing <br />grade. <br />c. Shelters constructed within the rear yard may be either <br />above or below ground. An above ground shelter is one <br />where the existing grade of the yard is changed in any <br />manner. <br />d. Below ground shelters constructed within the rear yard <br />need not provide for setbacks for either the structure <br />-3- <br />
