RE3OLUTION N0, 185
<br />WHEREAS, the application of Mr. R,B, Pahlmeyer, 1215 Financial Center
<br />Building, Oakland, to rezone the property at the northeast
<br />corner of First and Angela Streets, 400 and 412 Pirat Street, from an
<br />R-2 (One sad Two Faffilq Residential) Dlatrict to a C-T (Thoroughfare
<br />Cooasercial) District, having come before Chia Commission September 6,
<br />1962, under Asticle 22, Ordinance No. 309; and
<br />WHEREAS, this Commission does find that the granting of this applica-
<br />tion for rezoning does not conform with the Pleasanton
<br />General Plan;
<br />NOW, THEREFORE, BE IT
<br />RESOLVED, that the above-named application for rezoning be denied until
<br />such time as further studies can be made and it can be
<br />determined whether it would be desirable to engage the entire east
<br />aide of First Street as commesCial property in the definition of the
<br />General Plan and Zoning Ordinance.
<br />Vice-Chairman Landon then opened the public hearing on the application of Mr. Frank
<br />Auf der Maur and Mr. Konrad Rickenbach fora Variance from Sections 8.500 sad 17.302,.
<br />Ordinance No. 309, in order to construct 10 multiple dwelling unite at 568 St. John
<br />Street, in as RG-15 (Residential Garden Apartment - 1500 square foot ffinimum)
<br />District. Mr. Auf der Maur was present in the audience and presented his request
<br />for a driveway Variance of 2 feet 2 inches (from a 20-foot to a 17-foot 10-inch
<br />driveway), and a front setback Variance of 5 feet (from 25 feet to 20 feet), There
<br />were no further cotmments from the audience, and Vice-Chairman Landon closed the
<br />public hearing. Mr. Falea was called on for the staff report, and said the staff
<br />had looked over the plane and found that because parking had been provided in the
<br />rear and because the facade will be entirely landscaping and lawn, the 5-foot eet•
<br />back Variance constitutes a minor matter in this development, and the 20-foot set-
<br />back would be adequate to the staff. Likewise, the 2-foot 2-inch Variance from a
<br />20-foot driveway leaves adequate apace for two corn to pass. The second story will
<br />overhang the driveway. Mr, Falea said the staff recommends the Variance be granted.
<br />After discussion by the Commission, upon motion of Commissioner Antonini, seconded
<br />by Commissioner Wipfli, the following resolution was unanimously adopted:

<br />and
<br />WHEREAS, this Commission dose find that the granting of this Variance
<br />would not inhibit the public safety and general welfare, and
<br />would be in keeping with the spirit and intent of Ordinance No, 309;
<br />NOW, THEREFORB, BE IT
<br />RESOLVED, that the above-named application fora Variance from Sections
<br />8,500 and 17.302, Ordinance No, 309, is approved and granted
<br />by Chia Commission,
