MINUTE S <br />of <br />THE MEETING <br />of <br />THE PLANNING COMtffSSION <br />Pleasanton, California <br />September 6, 1962 <br />The regularly scheduled meeting of the Planning Commission was called to order at <br />8:00 P. M. oh Thursday, September 6, 1962, by Vice-Chairman Philip Landon. <br />ROLL CALL showed the following: <br />Present: Vice-Chairman Landon <br />Commisaioaera Antonini <br />Lozano <br />Raga <br />Wipfli <br />Secretary Falea <br />Ex-Officio Dana <br />Absent: Ex-Officio Bohn <br />Kamp <br />On motion of Commissioner Rega, seconded by Commissioner Antonini, the minutes of <br />'the meeting of August 16 were approved ae presented and unanimously adopted. <br />Vice-Chairman Landon then reopened the public hearing, continued from the meeting of <br />August 16, on the application of Mr. R.B. Pahlmeyer, 1215 Financial Center Huilding, <br />Oakland, under Article 22, Ord. No. 309, to rezone the property at the northeast <br />corner of First and Angela Straeta, 400 and 412 First Street, from an R-2 (Oae and <br />Two Family Reaidentiai) District, to a C-T (Thoroughfare Commercial) District. <br />Attorney Ned Robinson, repreeenting Mr. Pahlmeyer, spoke from the audience reviewing <br />the principal argumenea in favor of the application which he had presented at the <br />meeting of August 16. Iaquiriea were made by Mr, and Mrs. Henry Cook, 4138 Vineyard <br />Av~1., regarding further extension of C-T zoning of First Street. There being no <br />further comments from the audience, Vice-Chairman Landon closed the public hearing <br />and asked for the staff report. Secretary Falea said the staff report consisted of <br />two points: (1) This application has been made for a specific land use in a parti- <br />cular area, which oonetitutea spot zoning, in an area which is totally surrounded <br />bq an R-2 Zone. It is a specific request fora rather small parcel of property in <br />s rather large R-2 zone. The entire area east of First Street ie residential, either <br />R-1 or R-2. (2) The paraapunt consideration ie with respect to the General Plan. <br />Thin matter directly affects the central business district concept of the 1980 <br />General Plan. There is no commercial zoning contemplated in the General Plan on the <br />seat side of First SCreat south of Vineyard Ave. The philosophy of the General PlaD <br />accepts First Street ae the boundary line between commercial usage on the west of <br />First Street and residential zoning on the east. Commercial development has been <br />elated on the west side of First Street, but not on the east aide. The Southern <br />Pacific property has been historically tied up and will be tied up until at least <br />late 1963. Mr. Falea continued that it seems to the staff that this application is <br />in conflict with the General Plan and it aeem8 to be premature to allow commercial <br />development on the east side of First Street at thin tine. The key issue ie whether <br />or not Fizat Street should form the boundary between the commercially zoned and <br />residentially zoned areas. Personally, Mr. Fales said he does not subscribe to rent <br />lot lines as a zoning distinction, and believes a major thoroughfare provides a much. <br />better distinction. Commieaioaer Rega stated he also believes the street to be the <br />better boundary; the new freeway may transfer the flow of traffic; and it has been <br />the policy of the Planning Commission not to spot zone. Commiasioaer Antonini re- <br />marked that 1E Chie application is approved, a precedent would be seC and other ap- <br />piicatione of this nature might follow. Mr. Falea stated he believes the west aide <br />of First Street would be the ysoper place for a service station; it is already zoned <br />commercial sad the railroad situation hopefully will not remain much longer. Com- <br />missioner Lozano said 6e believes the east aide of First St.s~ill eventually be zoned <br />commercial, therefore, in hie opinion the subject application is justified. Upon <br />motion of Commissioner Rega, seconded by Commissioner Antonini, the following reso- <br />lution wan adopted by a vote of "Aye" by Commieaioaere Antonini, Landon, Raga and <br />Wipfli, and a vote of '1io" by Commissioner Losnnos <br />
